He had given me nothing but templates at the end and took down my website and over charged me, and wrote a different amount on the 1099 ($3,410.00).

Further he also billed me for plugins at an exorbitant cost of $789.95 when I had asked for a mock up. And then continued to bill me again even after I had told him to stop work.

I had another web person who took a look at it and verified that he had sent me nothing.

I am currently in discussion with Ryon (the client) regarding this complaint. To review:

    - The website was removed from our hosting environment with full permission from the client, due to lack of funding to complete the project and an inability to pay for our hosting costs (which were covered generously for over a year free of charge)

    - The website and all work performed was fully backed up; unfortunately, the wrong file was initially sent; this has since been rectified

    - All charges for work were originally agreed upon before the project began and in the service agreement; the total estimate for the project was between $7500 and $10,000, and although development stalled while more funds were procured, we are still very much within the original estimated cost

    - The plugins were not billed instead of mockups– this is untrue, and can be proven untrue through approval emails; mockups were provided at the start of the project, before a website environment was even set up; the plugins were billed once development began, and were only charged in order to continue development with the necessary features

    - A second annual bill for the plugins was sent automatically, but was immediately cancelled before payment could be made, and the client was contacted and asked not to pay it (MS-0005)

    - The amount on the 1099 was correct– it was determined that the client counted an invoice twice (MS-0003)

Since all work performed and billed has been provided to the client and is owned wholly by the client, we cannot provide a refund. The site is still usable and development can continue at any time, on any host of the client's choosing.

I am, and have been, fully available for communication and requests. Until this complaint was received, I was under the impression that we still had a business relationship and development would continue shortly. It was surprising to see, and unfortunate that my client felt the need to request a refund from me for the work I performed for her in good faith, with solid email and phone communication, for over a year and a half.

I am rejecting this response because:

    ****

,You have sent me nothing as files, "Twice", I do not have the budget to keep hiring people for work that was not deliverable. I asked for the files and you still have not provided me with any. You had done work I did not ask with the "Sale" sign, and I do not understand, why I had to pay for that I did not ask to do.You have decanted me at least twice and for a job that was close to $4,000, I have not received anything.

    Ryon

    Regards,

    Ryon Peck

I sent the files more than twice. I sent the site for you to migrate more than twice. I responded to your complaints with answers and assurances. If you cannot read or understand what I am telling you, there is nothing more for me to say.
