    I paid *** ****** $3500.00 for an expert testimony report for a court case involving over-demolition and poor restoration of my home. He has no interest in properly completing the job. All I got is a worthless draft from someone else in his office. So I rewrote the report and sent it back asking *** ****** to review it as though he wrote it based on my documentation, pictures and descriptions. He replied with "Yes approved". I sent the report I wrote to my attorney who sent back his marked-up version indicating a lot of missing information. I told *** ****** I have the mark-up and it needed a lot of work. I emailed it to him to review and be prepare. I asked him to come to my house to go over documentation and pictures to make everything accurate. He said he would the next week. He did not show up. I got another version of the report via email from the office assistant. It did not address any of the issues in the mark-up. She just deleted some of it. I responded and said as much. I suggested *** ****** needed to find a engineering report on Victorian era homes so that he could cite it as a resource. She replied she is not qualified to write such a report and resigned from my project. I have had a very difficult time communicating with *** ******. He doesn't answer or return my calls. He has made several appointments and not shown up. He has flat out lied to me many times. I told him that I have gotten nothing of any value from him and I have no confidence in him. He is irresponsible, incompetent and I do not want him involved in my court case. I want a full refund as I have already wasted money having my attorney review a report that I had to write. He has texted me and says he will give me a full refund as soon as the money is available. I have gotten nothing but more lies and delays.

     I am rejecting this response because:


    This response from *** ****** fits exactly the pattern of behavior
    that led me to lose all confidence in him and his ability to do anything
    of any use whatsoever. It is largely a complete fabrication based only
    loosely on actual facts. It completely mischaracterizes literally
    everything it attempts to explain. It also puts us right back in the
    same place that every other action this person or company has taken thus
    far.

    At the end of his response, he
    promises to pay me a full refund, which he has already told me in phone
    conversations and text messages many times. I have gotten nothing.

    *** ****** came to my home by my invitation supposedly to take on the task
    of writing a report that my attorney wants to use as expert testimony in
    a court case. I explained everything about the situation that I know
    first hand. I provided him access to all of the documentation that I
    have. I encouraged him to examine the current condition of my home. I
    showed him a huge assortment of pictures that he could use. I told him
    that I would help him understand any of it at any time. All of this was
    in our first meeting.

    The issue of the
    court case was something that had already happened to our home and was
    over and done with. It was not an ongoing situation. So it had no way of
    getting any more complicated. He was able to see every resource I could
    make available to him before he decided to take the job and send me an
    invoice.

    I told him that I was still
    waiting on getting answers to our discovery questions through the court
    process and from that, I hoped to get a lot of pictures that showed the
    condition of the house right after the fire and before any cleanup or
    demolition was done.

    Absolutely every
    interaction I have had with *** ******, since I made the unfortunate
    mistake of trusting him and paying him, has been a complete waste of my
    time. I have had to contact him every time I wanted to engage with him.
    He would tell me that he was working on it and then I would never hear
    back from him until I contacted him again. All he has ever done is make
    promises that it will get done sometime "next week" and it never
    happens. Next week never comes.

    His representation of events and of my actions in his response is so false it is just disgusting.

    I have all of the emails, drafts of the report and text messages to prove exactly what I am saying.

    So, if at the end of his response he says he is going to pay me;

    (his exact quote)
    "We are actively working to resolve this matter and will process the refund as soon as practicable."

    My question is very simple.

    When?

    Let us now set a date on which I will receive my full refund amount of $3500.00.

    After
    that date comes and goes, if I have not received my refund then anyone
    monitoring the processes within the BBB will also understand that *** ******** word is worth absolutely nothing.

    At that time I would like some help escalating this issue to the next
    level, presumably with the Ohio Attorney General and Consumer
    Protection.
