    This was for construction of a retaining wall. Payment for materials and deposit were made May 25, 2023. Project was supposed to be completed in July. Contractor removed a porting of the existing wall in July/August, but never returned. Many excuses have been offered, labor shortage, COVID, truck broken down, etc. I have a copy of the contract and a variety of e-mail and text correspondence with the contractor.

    In and Out Creations LLC gave us a quote for an aluminum fence and grill pad on 1/13/22 with a request for 50% due upon signing of contract. On 2/28/22 In and Out Creations LLC resubmitted the quote to be more competitive with other offers which was agreed upon by both parties. On 3/23/22 we sent In and Out Creations LLC the HOA Form and plot. Jeff G***** requested $1850.00 to cover the cost of materials up front. He was sent $20.00 on 4/4/22 and $330.00 on 4/5/22 via ***** and on 4/4/22 and picked up a check for $1500.00 at our home on 4/7/23. On 4/27/22 we requested an update on the fence and was told that the job would begin soon. On 5/2/22 Jeff G***** said the fence had arrived and that the job would begin soon. On 5/5/22 Jeff G***** said the fence arrived and that it was 6 inches taller than the neighborhood fencing and that there was a 24 to 30 month wait and he would check with other places for availability. That marked the end of communication from In and Out Creation LLC. We have made numerous attempts to reach the company via phone, email and texts with no response. We are requesting a full refund for services not provided.
