The Middlesex management company has ignored emails and phone calls for 4 months now regarding a noise issue that is violating my lease. The Middlesex Management ************************ has explained they can only send letters. This is not stopping the activity that is violating my signed lease by me the tenant and by Middlesex Management. The negligence towards their tenants is mind-blowing. I have written to Middlesex Management to break my lease only to be ignored. They will answer other emails about noise compliance but will not respond to my email about breaking my lease.Business Response

We understand the situation is frustrating, but we have been working directly with this tenant regarding his noise complaints. There is a set legal process to handle tenant to tenant complaints that we have to follow, and unfortunately it does take time. We will continue to work through the process with this tenant but we are not going to let him out of his lease. If he would like to terminate his lease, he can, but there is a $400 lease break fee he will need to pay and he will be responsible for his rent until the end of his lease term or until the unit is re-rented by someone else, whichever comes first.Customer Answer

I am rejecting this response because:
The Middlesex Management Group has been aware of this issue for over 3 months with formal compliant letters being sent on Jul 6, 2022 Aug 7, 2022 Aug 28, 2022 and Oct 12, 2022. The management company legal supervisor ****************** has not returned any of my calls over the past week an a half. The management company is not honoring my lease as the lease states the property would be quiet after 10 pm. I was informed by the Middlesex Management group that after the third month the tenant who I am complaining against would receive a letter to leave the property but if they refuse to leave and refuse to show up in court the **************** said there is nothing they can do. To which I asked to speak to a supervisor and I have left two messages and have not been called back once. How can the Management company do nothing against a tenant who is violating their lease but they can enforce mine. Does not seem to make sense on my end. The lack of communication and amount of complaints on the BBB website and on ****** show the amount of neglect this management company has against their paying tenants. This company should be shut down for how they treat paying residents. The building is great and I am happy with the apartment but the management company is the real problem. They are rude unresponsive and do not care about the people who are paying to live in their residences. I find it ridiculous but not surprising due to the lack of competence that the management company would even suggest charging a tenant who has dealt with horrible living conditions that the Management company cannot solve.

We have been in contact with ************** since he began reporting his concerns in July. We received the first complaint against his neighbors in July and we sent the first Notice to ***** (NTC) to his neighbor on 7/20. On 8/3 we spoke to the tenant and explained the process we need to follow; we explained that though we received a second letter from him on 8/1, because we had just sent the first NTC it was too soon to send another. We need to give 30 days for a tenant to comply. We sent a second Notice to Cease on 9/1. On 10/7 we again spoke with ************** at length - he was upset and felt nothing was being done, and we explained that we had not received another complaint from him since we mailed the second NTC, so we assumed his neighbors had complied. ************** submitted another complaint on 10/12, which we are acting upon. We have explained the process several times, and while we understand it is frustrating and slower than ************** wants, there are just no shortcuts in this process. The end result is an eviction notice, and in order for that to be taken seriously by the courts, the appropriate steps need to be followed. He was also upset that he would need to go to court; we explained that because we are not witnesses to any of these events, we cannot testify on his behalf. He is the one making the complaints, and he will need to go and make them to the court. His concerns are not being ignored, and we have spoken to him at length, but there is still nothing we can do to speed this up or change the requirements. If the roles were reversed and he was on the receiving end of these complaints, we think he would appreciate the care we take before we move towards eviction.Customer Answer

I am rejecting this response because:
The Middlesex Management group has every tenant sign a lease agreement. In this lease agreement Under Section 36 Rules and Regulation states "The Tenant shall not make or allow any disturbing noises in the premises or on the grounds. The tenant shall not do or allow any conduct which will interfere with the right to peaceful enjoyment of other tenants. This conduct includes, but is not limited to, playing or allowing to be played loud music, television, musical instruments, shouting or running, especially during the hours of 10 pm and 8 am.". Since the Middlesex Management Group is not withholding the terms of my lease that both I and Middlesex Management have signed Middlesex Management is violating my lease terms. I see in no way that I am liable to have to go to court because my lease terms are not being withheld by Middlesex management. Middlesex Management in their lease ensures a quiet environment yet when there is not one they assume no responsibility. My complaint is against Middlesex Management not about my neighbors. Middlesex Management has not been withholding my lease terms. Both parties who sign a lease are responsible to withholding the terms. Again, my complaint is about Middlesex Management not honoring the contractual obligation they have to Section 36 in our lease agreement. The Middlesex Management group has had more than enough time to take action against these conditions. I would also like to add that Middlesex Management mentioned that both tenants would need to agree to appear in court and if both do not agree nothing can be done. Well if I knew I was breaking my lease but I could get away with it by refusing to go to court why wouldn't I. Also, what is the point of signing a lease agreement if the management company cannot withhold it. I will not be wasting my time to go to court against another tenant. But I will gladfully go to court against a management company that does not honor their lease agreement. So from what I have gathered from this Management company is that a lease agreement means nothing. They have no way of enforcing it, well unless it stands to benefit them. I also notice they did not mention the lack of communication by their supervisor but simply ignore what I wrote seems to be somewhat or a trend with this group. Just ignore it and try to get away with it...great business practice.
