    I am writing to formally lodge a complaint concerning an incident involving the office in *********, specifically regarding one of they engineers, *********** *. **********************, ***** is important to note that Mr. ********************** was contracted by the ********************** (HOA) and not by me. My concern centers around his unauthorized entry onto my property, which is enclosed by a fence, without my prior knowledge or consent. He conducted inspections on behalf of the ***, potentially to prepare for legal action.While I understand that Mr. ********************** is acting on behalf of the **** my issue lies with the manner of his approach. He entered my property without any permission or prior notification, proceeded to take photographs throughout, and did so without informing me. This behavior is particularly troubling as I have a wife and young children at home, and it raises serious concerns about professionalism and ethics.I have familiarity with the firm he represents and recognize that it has a good reputation. However, this incident involving Mr. ********************** does not reflect well on that reputation. Despite reaching out to him regarding this matter, I have yet to receive any acknowledgment or apology.I am requesting a formal apology and expect that in the future, Mr. ********************** or any other representative will seek permission before entering my property.

    Mr. ************** I mentioned in our email correspondence, you will need to discuss the specifics related to the entry and access with your Association, who engaged me to perform the inspection.  As described in the report, the inspection was for the drainage easements that run through the rear and sides of homeowner lots as well as the *** common area below the lots.  You should check with your Association with regard to access to the easements and common areas in the neighborhood.  That is not my authority to discuss.

    I am rejecting this response because: Whatever the mandate or reasons for this engineer, he should have respected professional ethics and obtained permission to access my property. I am not referring to the report he made. He justifies his access without needing to ask for permission based on the reasons he listed above, and he refuses to apologize. In our home, during our intimate moments, we sometimes do not wear clothes, and  months ago, when this gentleman came over, my wife had to run and change upstairs because there was someone taking photos outside our terrace. I arrived shortly after, but by then, there was no one there, and we were frightened. Following this incident, we installed cameras because we have small children. But does this gentleman realize that in a situation like that, not knowing who he was and seeing him taking pictures of my wife naked, I could have come out and shot him? What he did is insane; he should have ask before enter, and he didnt.

    Sir, I have no idea what you're talking about with your wife and children. 

    I made known the date of my inspection to the attorney and Association for notifying homeowners.  Per the request of the Association in coordination with the Association's attorney, I performed the inspection of the common area drainage systems.  To my understanding from information provided to me, the common area drainage systems include the drainage easements on your lot and all of your neighbors.  This is why the Association had them all inspected.  

    As I continue to state, you should discuss this with the Association and their attorney, as they are the ones that allow access to the common areas and common area drainage systems per my understanding.  

    In summary, to my knowledge, I did have permission from the entity responsible for access of the easement on your lot and for the common areas.  If you disagree, that is fine, but your disagreement is not with me, since I cannot interpret the governing documents for your community, since those are legal documents.  This is why I've continued to state that you need to discuss this with the Association and/or the Association's attorney.
