    Andre agreed, in writing, to backfill dirt into a low bay of my garage because it needed to be level with the rest of the garage floor. Andre dumped the dirt in my driveway but failed to backfill the garage as promised. The dirt pile remained in my driveway for over six months blocking two of the three bay garage. Finally, after repeated calls to complete the work, I hired another contractor to finish the job.

    Andre's did not finish the job.  I had to pay another company approximately $485.00 to complete it.  I would like a refund in that amount.

    Dear Better Business Bureau,


    I had a contract with this individual to complete a brickwork job, and I told the customer I would try and fill the dirt, which I finished the brickwork to a high standardthe final result was beautiful and met all expectations. After completing that work, the client asked if I could still help move dirt in his garage. I informed him that my equipment (a **** Deere machine) was not operational, but I would try my best. he paid me in full for the brickwork. I made it clear this assistance would be a favor, not a paid service, as there wasn't a paid agreement or contract for this additional work. We were unable to complete the dirt-moving job because of my equipment failure, which I communicated to the client. He acknowledged this and agreed to find someone else to finish the task. At no point did we receive any compensation for the dirt work, nor was it ever expected under the circumstances. Now, I am being told that I owe $425 in relation to this job. I do not understand the basis of this claim, as there was nonpaid contract for the dirt removal, and I was performing what little I could as a gesture of goodwill. I believe this may be an unfair attempt to get additional services without payment I never charged for the dirt that I had paid someone to bring to him. I would appreciate any assistance the BBB can provide in mediating or resolving this situation.

    I have reviewed the business' response and am rejecting it because: Andre Tuckpointing's description and submit the original contract for the work at my address at ********************************************  See copy attached to this email.
            Part  2 of the contract clearly and unequivocally shows that Andre was contractually obliged to "BACKFILL" the garage.  The contract does not say the work is contingent on the condition of his equipment and I never said I would excuse the fulfillment of part 2 of the contract by hiring another contractor.  That's a lie.   All the work at my property was to be done under the original agreement, copy attached, which was paid in full.  However, since the work was to take several months to complete, the completion dragged on for a year, the excuse that his **** Deer was broken.  **** Deer had nothing to do with the contract, just a lame excuse, because it is immaterial how he fulfills the contract.
            Andre did acknowledge my request for reimbursement for $425 paid to another contractor to finish his work after at least three attempt had been made to get the work done.

    Thank you for your response. We understand your concerns regarding the completion of the backfilling at your property on ***************
    We would like to clarify that the backfilling was not included as a paid item under the original contract. This portion of the work was performed as a favor, not as a formal obligation. ***** spoke directly with you at the time and explained that our equipmentspecifically the **** Deerewas out of commission. You acknowledged this and indicated you would arrange for someone else to complete the work if necessary.
    Despite that, we made an effort to accommodate your request and delivered the dirt to your property as you requested, at no additional charge. We regret that this situation did not meet your expectations, but we stand by the fact that we went above and beyond the contract in trying to assist you where possible.
    We appreciate your business and hope this clarifies the circumstances from our perspective.

    I have reviewed the business' response and am rejecting it because:
    Andre Tuckpointing  and Brick Work simply failed to preform on their written contract.  Not only are they derelrct in their written word but do not speak the truth.  I will win in court but the amount is too small to require a judicial review.  The matter will be settled in the long run in the court of public opinion.

    082725JM: Mr. ****** called and stated everything has been repair/fixed and refunded thanks the BBB for everything and wants this complaint "Close" 

    090925JM: Mr. ****** called and confirmed everything has been repair/fixed and he did received a refund check and the BBB may "close" this complaint at this time.

    082625JM: Brain called me back and stated that ******* **** is investigating this complaint with the operation manager and will give me a return call on 8/27/25.

    082725JM: Ms. **** returned the call and confirmed that her company has taken care of Mr. ******* by fixing a few things and giving him a refund and has request for this complaint to be "Close" as "resolved".

    090525JM: Left another message *****-President to give me a call to confirm that everything is done and the refund has been issue to the consumer. 

    090925JM: Ms. ************** call back on behalf of the President-***** Andre to confirm that a refund check was issue and repair work had been done and wants to make sure we close this complaint as " Resolved". Ms. **** will be working directly with the consumer to make sure everything is done correctly in the future.

    I called them 3 times and they will be down to tuckpoint the rest of my chimney. The owner came and said they will finish my chimney for $100. I have called them several times and they have yet to respond or call me back. I have seen them in my neighborhood many times. They told me that the will be to my home a couple of times and they never showed up when the said they were. He did not keep his word.

    Yes, we told her that we would come back and do the extra work for an additional $100. which has nothing to do with the original work performed. we will get back there when we have time to do the additional work which has nothing to do with the original work.
