I was sent a demand for $100 from The Missing Well, Inc., March 18, 2025, by certified return receipt by mail. I never received any explanation for how I am not in compliance. I was told that I have 30 days to clean up my easement in the letter. The letter was dated March 1, 2025, but I never received this letter until March 18, 2025. It was mailed from the Warsaw, MO, Post Office March 12, 2025. The letter states that in 30 days, which would be March 30, 2025, that my fine would double for failure to comply. That would be $200 plus the $100, totalling $300 in less then 2 weeks. For the record the first $100 had to be paid and the easement "cleaned-up" in less then two weeks to obtain compliance. I've contacted the HOA about the fact of not getting 30 days, along with other concerns of there being no legal way to establish where the easement is but I have not gotten an answer. After reading the HOA rules it looks like they can arbitrarily bill fines to you with no notice or explanation or timelines. This gives them a blank check and this is far from fair. The rules also do not state footage for easement from the road. I complained that I never recieved a notice of violation before billing me. I was told the letter sent in Nov 2025 was my warning, although it was a general letter sent to every member.
I wrote the HOA asking what was in the easement causing the problem so I would know what they wanted done and the actual footage. Finally the Secretary told me there were some wood piles in the easement and a fence. I burn wood for heat and had a large pile of wood in front of my garage, which is about 24 feet from the edge of the road. And I have a rack of wood near my house about 18 feet from the road. And the fence was a piece of old rot iron fence that was to be hauled off, that was about 20 feet from the road that is gone now. No answer on the footage. Note, my home was built here before there was an HOA, and my home was built close to the little road I live on.

    Business Response

The board of the HOA voted in the April meeting to drop the fine and implied to her that she is not banned at any meeting.  After talking with *** ****** she agreed to all that was discussed and we voided and returned her check she had submitted for the fine.  This matter was resolved to her satisfaction and to the board's satisfaction.
Hope this helps to clear up the matter.

    Thank you,

***** *****, Secretary/Treasurer for Missing Well Inc HOA
