We took him to Small Claims for recovery (case #20-1665-sc-1) and on Jan.6, 2021, received a judgment against him....but he failed to pay. When subpoenaed for Discovery of Assets, he failed to appear at the hearing. At the resulting Show Cause hearing to explain his absence, he perjured himself under oath, claiming he had no money, no home and no assets and falsely accusing us of not obtaining necessary permits and inspections, as required by law.
If a contractor takes a deposit and bolts, it is a civil offense pursuable in Small Claims court. It is not a criminal case for which he can be arrested, unless the prosecutor sees a pattern of repeat offenses as a defendant in Small Claims.
Because of B*********'s extensive history of being a defendant in 86th Dist. Court, the County Prosecutor charged him with 2 misdemeanor counts of attempted fraud and 2 felony counts of attempted fraud (case #204541FY1), with us as named victims. After many court hearings, B********* pleaded guilty to the misdemeanor charges in exchange for dropping the felony charges.
He failed to pay restitution as required by the criminal court order, so the judge issued a bench warning to him. After still failing to pay, the court turned the matter over to a collection agency.
As of Jan.4, 2022, B********* has not paid restitution. We have learned many lessons since finishing off our basement. Chief among them is: If a contractor asks for a deposit, that's a red flag. NONE of the subcontractors who worked on our project ever asked for payment until their job was complete. Legitimate contractors do not need a deposit.
