    I bought a house from ***** ***** (builder) on June 22,2023. This home was 95% brand new. Per our contract ***** was supposed to provide me a Builders Warranty and also warranties for all the new appliances, hot water heater, A/C unit, mini split wall mounted units (2), and windows.

    The only warranty I received was for the new refrigerator. Mr. ***** is in breach of contract.

    Less than 1 month after we closed on the home, the tenants that were living there said the AC was not working. I called Mr. ***** several times, sent several text messages and reached out to his agent ******** I was ignored by Mr. *****. I would text him several times a day until finally after weeks went by, he gave me the phone number of the HVAC person who installed the mini split units. This person never answered me and didn't respond to text messages. ******* his agent helped out by giving me another number to try and this person came and looked at the unit and said it needed more Freon. He put the Freon in the unit but the next day the units were not working again per the tenants. I called the service man again and he said I was out of luck he was not coming back to fix anything. He said don't call him anymore.
    I then called a HVAC company that I trust and have used for years to come and look at the units and they did. They had to come back twice to diagnose the problem and it was that the lines to the units were not installed properly. They were put in backwards. This cost me $578.00


    Because the closing was so rushed and the house was not completed Mr. ***** had promised to complete several things to the house both verbally and in text. Which his real estate agent ******* ****** can attest to. The reason Mr. ***** pushed so hard to close on the 22nd was because he was going to have to pay another mortgage payment.

    In addition to the A/C breaking, there are a list of items that were not completed before closing.

    This was not a new construction home. This was a Remodel of a
    late 1800s home.

    All necessary permits were pulled and inspected by the city.

    The agent in her complaint, brought *****, the client, into the
    transaction.

    She had two total home inspections during her 30 day
    contract phase. Buyer requested adjustments that were made after the first and
    second inspections.

    She signed at closing and was not forced to close on the
    property.

    Buyer had requested a builder’s warranty however that was
    declined due to the property being a remodel not a new build. There is no
    builder’s warranty in the contract or the addendum that was signed at closing.
    There was a 24 month plumbing warranty on original installation craftsmanship.
    The plumbing warranty however won’t be valid if proper care is not done, being
    that this is a rental.

    She was given all necessary warranty information for the
    appliances, all of which were purchased at the same time under the same account.

    The buyer made several disparaging comments to all parties
    involved in this transaction throughout the whole, including workers and vendors.
    Her number is blocked due to harassment and legal action has been considered.

    Please close this complaint due to no factual evidence.

    I Reject this Response because...........

    Per our contract (see attachment) Mr. ***** was supposed to give me all the warranties for the mechanicals, windows, roof and appliances.  I am missing the windows, roof, stove, dishwasher and microwave warranties.  Also, per our contract, a mulch bed was to be done in the front of the house before closing.  This was never completed.

     

    The AC mini splits in the upstairs bedrooms were installed poorly and did not function properly.  As a result of Mr. ***** not taking accountability for the home he sold me, I had to call an HVAC company to come out and fix the problem. This company fixed the problem and also let me know that the wrong breaker was installed at the breaker box, which they fixed as well.  It cost $578.  The invoices are attached explaining the mini splits were installed incorrectly as well as wrong breakers installed according to manufacturer specifications.

     

    Along,with the mini splits not working, Mr. ***** did not complete several other items to the home.  Kitchen hardware was to be installed, (you couldn't open the kitchen cabinets), install bathroom light covers, seal attic, finish painting.  These items were never completed.  There are text messages between, me, Mr. ***** and Mr. *****'s agent attesting to these items being completed.

     

    I have an issue everytime it rains, water is coming from under the backdoor and also the upstairs window is leaking as well.  This is another result of poor workmanship.  

     

    My total expenses come to $1,428.  I feel Mr. ***** turned his back on this property once we closed.  He never completed any of the projects he was supposed to and did not give me all the warranties per our contract.   Every day that goes by I am having more and more issues because of poor workmanship.
