JB Property Maintenance trespassed and destroyed vegetation on my property in June of 2024. Called Justice Binder @ 8:10 AM on July 12 and discussed the issue. I explained to him that property line was well marked with metal fence posts. His company cleared area approximately 20/30 x 100 of my property without permission and that the property is well marked with No Trespassing at the street. ******* admitted running over one of the fence posts with his Bobcat. He said that he will be at the property on Sunday (7/14) morning and would call me to further discuss. He never did contact me.

    Business Response

    Date: 08/29/2024

On May 13, 2024, *** and ****, the neighbors to the right of ********************* driveway, engaged my company for various tasks. In May, we commenced grading the hill to prepare for a swing set for their child. In early June, ********************* approached my employees, demanding the planting of multiple evergreen trees that were not on his property.
***** subsequently called to discuss the issue. However, his explanations were unclear and inconsistent, with new problems emerging with each statement. For instance, he claimed we had cleared 20/30 x100 feet of his property, which did not occur and was not part of our work on his neighbors property.
I proposed meeting ***** at noon at his neighbors property to address and resolve the matter. Unfortunately, ***** did not attend the meeting, leading me to disregard the issue due to his failure to show up.
Additionally, while operating a bobcat on the site, I inadvertently ran over one of *****'s marking stakes, which was not on his property.
Given these circumstances, any further disputes should be addressed through legal action, as the current situation has escalated to harassment.

    Customer Answer

I am rejecting this response because:

The business's response is half-truths or outright lies.  I did approach his employees and informed them that they were clearing my property.  They commented that they were surprised that I was calm and professional in my behavior.  I did not demand, I simply requested that 2 or 3 evergreens be planted along the property line since they had cleared trees and underbrush on my property.  His employees gave me Justice's card and said to call him.  I did call him and he admitted running over one of the property markers, at the end of the conversation he said that he would be at the property on Sunday and he would give a call when he was onsite so we could meet and discuss the situation.  He never called.  Aly & ****'s surveyor, my surveyor, MACOG, and St. *************************** all agree on the property line.  When ******* never called as promised, I E-mailed him, when he didn't respond to the E-mail, I texted him with no response.  I then contacted the BBB.  I hardly consider my actions harassment.  The legal actions suggested by Justice will be much more expensive than two evergreens.  I purposely had not cleared my property along the perimeter to afford me privacy.  Aly & ****'s house very very close to the property line as shown in the attachment and I simply wanted some privacy.
