The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government's allegations, which have not yet been proven. On August 5, 2019, the Indiana Office of Attorney General commenced a civil action under the Indiana Deceptive Consumer Sales Act for injunctive relief, consumer restitution, civil penalties, costs, and other relief. The action alleges that Frank Eversole, Jr., acting as the principal of Professional Plus Tree Service, entered into contracts with consumers to home improvement work and subsequently failed to complete that work. The action alleges that Frank Eversole Jr. violated the Deceptive Consumer Sales Act, the Home Improvements Contract Act, and the Senior Consumer Protection Act.
