    I applied for a apartment at the icon Waverly, paid the $200 admin fee. I was denied but they didn't call to tell me I was denied, I found out on my own. I have called and emailed and the property manager about my refund, and one person act like they didn't see that I paid the $200 admin fee. I recieved about a request to have money refunded back but nothing has happen. I emailed receipt showing I paid the $200 admin fee. Still no response nor my $200.

    FUTURE TENANTS BEWARE. Icon Waverly formerly known as Brookside Properties is scamming tenants into living in uninhabitable apartments. We recently relocated with a new job opportunity and found the idea of being able to rent short-term while we purchase a home very appealing. With that being said we went off of what the "Model" apartment and front office looked like to judge the actual apartment since they were not ready to be viewed at the moment. The office is decked out with fancy workout machines and the models are very nice and clean. With the excitement and short timelines, I did not take the time to read the online reviews! To keep this story short in less than 24 hours from moving in we were having a very hard time breathing, and were getting sick, my physician said this was not healthy for the pregnancy. Pictures of over 10 major issues were forwarded to the office after letting them know we had to move back out immediately. Pictures included the master bedroom with 3 ceiling leaks, all sinks underneath showing mold and water beneath them, and the toilet bowls still having discharge from the previous tenants. The office reply was: "After everything was reviewed. We will not be able to cancel your lease. You are still responsible for the lease that you signed. We do hope that you will want to stay with us at Icon Waverly. If you do not want to reside in the apartment you will need to sign a 60day written notice to vacate and a two-month termination fee will also need to be paid before keys are turned in. I also noticed you rent has not been paid if rent is not paid I will have to file eviction which will have a $300.00 legal fee added on top of the balance." At this point, we will be seeking legal counsel because this is too much abuse, and the idea that military families are having to go through this disrespect just makes me even more upset.

    Unfortunately, your statements are untrue as we did complete a walk though inspection with you where you signed off on your new apartment (the exact unit) as well as made no mention of any issues at move-in nor have you submitted any service requests since. It is very unfortunate that your move here did not go as planned with your job, but unfortunately when you enter into a legally binding agreement you are held to that just as we are.

    Additionally, you did receive notice as you had not paid your rent since signing for possession of the home. Unfortunately this will negatively effect your credit as well as be reported to any future landlords.

    While I understand that may not be the response you are hoping for, we wish you the best of luck and are available to further discuss your situation if you so choose, all information is available in the copy of the lease we provided to you as well for reference.
