september/26/2024 6.160.00$14 day psi ( pre-sale inspection )To ignore the car's faults.The business is making no effort to resolve the issue.I purchased the vehicle as a green light and paid an extra $170 for a pre-sale inspection. They provided a 14-day auction guarantee for this vehicle. The car was towed to my business, and there wasnt a single drop of coolant in it. I added coolant, and it leaked out immediately, as if pouring from a bottle. The rear main seal was leaking oil, and the rear differential was also leaking oil. Since I had the right, I sent the car back and opened a file to initiate an ARB. They got back to me on the last day of the legal period and informed me that they did not accept my claim, stating that the oil leak was inactive. They did not provide any explanation regarding the differential. For the coolant leak, they claimed it was a very inexpensive repair. I wanted to send the vehicle to the authorized dealership, but *** manager D.B. refused. I also requested that they share the *** report they conducted, which I paid an extra $170 for, but they refused that as well. They told me that I had no rights at all, but I know very well that I do have certain rights. Despite this, their non-compliant behavior has become unbearable. I am tired and frustrated by their unjust treatment. Someone in this position should behave more fairly, as the opposite only reduces trust in the company, leaving the impression that it is an unreliable firm in the eyes of customers. I will take the vehicle to the authorized dealership at my own expense and obtain a report regarding the faults. I will also share this report with the relevant authorities. CTN Motors purchased a 14-day PSI on their unit, and opened an arbitration within the valid arbitration window on day 3. The vehicle was inspected and found to have seepage from the rear main seal and the rear differential. Manheim Texas Hobby did find a coolant leak from the coolant cross over pipe.
Per the NAAA guidelines, leaks classified as seepage are not an arbitrable issue, and mechanical issues must be over $800.00 to qualify as a valid claim. Manheim Texas Hobby found the coolant leak to be $612.47 (quote attached). Manheim Texas Hobby contacted CTN Motors on October 4th and explained fully the reasoning behind their decision on each part of the claim.

I am rejecting this response because:
A vehicle with such a significant coolant leak could have been without coolant for a considerable amount of time. For example, if the vehicle was running for about 30 minutes before its turn during the auction process, as you mentioned, the lack of coolant could have led to overheating, potentially causing damage to the engine, such as a blown head gasket.
The probability of the head gasket being damaged is indeed high, especially given the circumstances you described. With the vehicle running without coolant, the engine would likely overheat, increasing the chances of the head gasket being compromised. A head gasket failure can cause further engine damage, leading to costly repairs.
Regarding the Pre-Sale Inspection (PSI) that you paid $170 for, it is critical that the mechanics perform specific tests, including a cylinder head gasket test, especially in a vehicle with such a major coolant leak. If this test was not performed, it would indeed raise questions about the thoroughness of the inspection, as this test is crucial for evaluating the engine’s future performance in such conditions.
As for the rear main seal leak, you are right to ask if the oil level was checked. In a vehicle with an active oil leak, ensuring the oil levels are correct is critical for verifying whether the engine has enough oil to function properly. Similarly, the differential oil levels should have been inspected. If there’s no oil in the differential, it could lead to a failure that may not manifest as an active leak but still indicates a serious problem.
Regarding the NAAA explanation about oil leaks not actively dripping, you correctly pointed out that this requires an inspection of the oil levels in the mentioned components. If those components are running dry, it would explain why there was no active dripping, but that doesn't mean there’s no serious issue.
Lastly, you are justified in questioning why the PSI report, for which you paid, has not been sent to you despite multiple requests. Since you paid for the inspection, you have the right to access the full report. It’s important to insist on this, as it provides vital information about the condition of the vehicle and the accuracy of the inspection performed.

I am rejecting this response because:Unfortunately, none of what the auction claims is accurate. The authorized dealership has stated that the PSI report conducted by the auction does not reflect the truth. This is evidence that the auction's ARB and mechanics have conducted an unfair arbitration.I know that the auction officials will not request the authorized dealership's report, but I still find it appropriate to include it. The authorized dealership also sent me a video explaining the issue, but I can't upload it here because the file size is too large.

on August 28th I picked up my car from the repo lot after paying $1,100 in full. When my car was returned to me it was not returned in the original condition. While on the lot, my car was severely damaged. License plat was bent, front window cracked, rearview mirror removed, armrest leather cracked. damages were proven to be done onsite after before and after photo verification was completed. On 09/12/2024 I purchased a 2014 Chevrolet Express online during an auction. The ad for the bus said that it runs and drives. When my transporter was there to pick it up the van would not start. I paid the average price of $5030 for a running and driving van. When in fact it was an inoperable vehicle and I would have never purchased. It was false advertising. ********************* purchased the vehicle through a TRA sale at Manheim Chicago. Only odometer issues and title brands are subject to arbitration in TRA sales. The Condition Report did indicate that the vehicle was drivable which is plausible that the unit was operable at the time of sale. However, there are no guarantees that a vehicle will remain operable when it is sold AS IS and even more so through a TRA sale. This is in reference to a 2012 Jeep Liberty Vin # ***************** I am the seller, **********************, owner **** ******. I sold this vehicle on OVE As-Is. I turned the title in and it was validated and I was paid for the vehicle. The vehicle was shipped by the buyer to *********, ****. the vehicle was arbitrated for no title, and I was never notified of this arbitration whatsoever. I have made several attempts to speak with the right people in regard to this vehicle and have gotten nowhere except running in circles. As the seller, I am supposed to be made aware of an arbitrated vehicle. Also, I have a phone recording from a Manheim Atlanta employee stating that this claim was closed to "hastily and that I was not given the proper amount of time (nor made aware of the arb) to correct the transfer document considering the title was in-house and validated. Now the vehicle is in Manheim ******** and I got charged unjustifiably $700 for transport all the while I was never made aware of the arb claim in any fashion. I was also told by the Manheim Atlanta employee that the car is inop. This vehicle when sold ran through the lane. I should not be liable for this vehicle in any manner considering I was never made aware of the arb claim and it shows I did not, according to the Manheim Atlanta employee. And; besides the transfer form having a mistake on it which I'm correcting, Manheim itself made a mistake by validating the paperwork and paying me on the vehicle. I understand mistakes happen but I should not be held responsible for manheims two mistakes 1. Validating the paperwork and 2. not notifying me ( the seller ) in regards to this arb claim. March 7th 2023. $5000 Redeemed car after repossession. Called before hand to confirm it was operational and no major damage was done. They said it was operational and I had to pay before I inspected the vehicle. They lied when they said it was operational. The car couldnt make it out the parking lot. Its a sports car so it would have to been someone taking it for joyrides. They said there was nothing they could do. Wasted days of my life trying to figure it out, and I didnt have the money to fix it after paying 5k to get it back. Sold our dealership a car with an open lean. Atlanta Georgia Manheim refuses to help. Manheim Georgia has been working with the seller to obtain the lien release as a courtesy to ****************. There was not an open lien on the vehicle, it was a repossession from the retail customer in the state of **********************. We've been attempting to contact Manheim Atlanta and Manheim Georgia for over 3 months. I have been told by countless people that this was getting take care of and that we would have the paperwork multiple times. After contacting TMCC, TMCC themselves said that Manheim has a TMCC *** there that would 100% give us the paperwork required for the State of ****** to finish registration for a customer. We have spoken to at least 10 different people, and not a single one of them knew about the situation, even though every time we spoke I was told that it was going to get taken care of within 24-48hrs. Here we are 3 months later, and we still have no paperwork. Manheim Georgia and Manheim Atlanta should limit sales to GEORGIA specifically if they cannot provided the proper paperwork for other states. I was told by you guys, "Atlanta DMV doesn't have problems with these paperwork so this is your problem". Very , very unprofessional behavior that needs to get looked into.

Summary of Complaint:On 8/08/2024, I purchased a vehicle through Manheim Texas Hobby that was advertised as drivable and operable in the condition report. Upon inspecting the vehicle after the sale, I discovered that the vehicle was neither drivable nor operable. Despite this significant misrepresentation, the auction has refused to arbitrate the sale, citing the as-is status of the vehicle.Prior to the sale, the auction did not allow buyers to obtain the vehicles key from security to verify its condition. We were forced to rely solely on the condition report, which inaccurately represented the vehicles state. This restriction prevented proper due diligence and contributed directly to the misrepresentation.Relevant Guidelines:According to the **** Arbitration Policy (August 5th, 2024):Sellers should avoid using ambiguous, confusing, or deceptive announcements or disclosures as these may be grounds for arbitration.The seller is responsible for the accuracy and completeness of all representations or descriptions.These provisions hold the auction responsible for ensuring accurate descriptions, regardless of the vehicles as-is status. Manheim Texas Hobby has discussed the arbitration claim with ****************** on multiple occasions. The unit ran "As-Is" and there are no grounds to arbitrate mechanical issues. The unit was also driving, operational and was driven to its location on the lot prior to the sale. Dealers are able and allowed to test drive units prior to sale day. 01/28/2024 There was a glitch in the system because bid, approval, invoice, and payment weren't executed during the transaction. After three months I saw my name on KO BOOK 1017. Since then, I have purchased other cars of which I burned out with bad engine. I heard Chicago Independent Auction filed a claim for non-payment. What is the duty of an auction? I didn't go to their website to bid. How have I owed ****** I hope Manheim solves this issue with ***** ASAP and free me from KO BOOK 1017 after 25 years with Manheim.Business Response

This can only be resolved by contacting Auction Insurance and/or the Independent Auction where the vehicle was purchased. The vehicle was facilitated through Chicagoland Independent Auction, which is independent of Manheim. Any payment, gate release, invoice etc. would be handled through the independent auction and not Manheim. When dealers do not pay for their purchases, all auctions and flooring companies report this to Auction Insurance. I am rejecting this response because: Again, I didn't go to *********** Independent Auction to bid, I was using Manheim/OVE which I have been using for the past 25 years with no issue until this incident occurred. Manheim/OVE failed to carry their responsibility. And that happen in the past. It took manheim 3 months to report that, meanwhile, I purchase 2 more cars with bad engine. If the deal wasn't void by them, I wouldn't have purchase those cars. My name must be remove from this nonsense KO BOOK 1017. No seller approval, No invoice, and no request for payment. Manheim is liable for this unfinished process. An auction is bridge on a deal. If the bridge is no longer exist, the deal is void, canceled, and dead.
