We finally closed one year ago and I am now assessing the damages, the least of which is $7000 out of pocket when our closing was moved several times because of errors that the agent made. I thought I would lose my husband, a heart patient before we closed.
Every day there was a costly delay, Each time the agent's answer was "How was I to know". Those delays were due to errors the agent made in the Terms offered by VA, Conventional Loans, no longer having current P&Ls, because of the agent's delays. Paying extra to escalate the multiple appraisals that could not be escalated". Every error, every delay was caused by something the agent should have known.
After closing, we were given keys to the wrong home and six days later asked to sign the proper papers for the home were in.
The problems started when we were a day away from closing. The agent announced that the property could not be financed by VA. Apparently, the agent didn't want to do the paperwork for a VA Loan. I checked with Washington, found that what she had done was actionable. In confronting her with this, we were told we could go elsewhere. That would mean starting over with another Lender after a month an half of paperwork. We had no place to live and were in a short-term rental. She agreed to give us her full attention and make the closing happen. She ultimately did the same paperwork for an FHA Loan that was needed for the VA Loan. Forty-five days later, after extending the dates of the rental 7 times, we closed.
We questioned the unexpected Mortgage Insurance on the closing documents and were told this would be dropped once we made improvements in our home. We have made $65,000 in improvements. In 2003 FHA had changed the rule the agent quoted. We could not have the Mortgage Insurance dropped with a higher appraisal. We will pay more than $30,000 during the life of the Loan unless we pay to refinance. Apparently, another thing that the agent was "not expected to know".
Hamilton Group sold our Loan to another company. The papers we signed said they would not. Today we found that our Insurance had lapsed. The Insurance company was billing Hamilton Group, not the new Lender. Apparently, Hamilton Group ignored the bills. We just went through a major hurricane with no insurance and have to straighten out this error at our cost. If this is typical of the Hamilton Group they should not be allowed fiduciary duties. If this is singular, then the agent should be fired. I am in the process of adding up the damages, including the cost of refinancing for our attorneys.

No loan documentation or comments indicate incorrect loan closing documents were sent. Please inquiry this with the closing agent that performed the closing Talon Title Services.
I inquired with our Servicing Department and a letter was sent to you on 08/07/2020 that as of 08/22/2020 the servicing of your loan will change. At the time of purchase/transfer a Change of mortgagee letter is generated and mailed out to the insurance agent that is on file in Encompass. All closings have a disclosure stating that the loan may be transferred to a new lender.
