    We contacted Yoder Homes in December 2023 to quote on a major home remodel for our house in ******************, we met at the house in December 2023, walked thru all the projects, provided them with our budget for the project. In January 2024 they provided a ballpark estimate which was just under the budget we provided and explained that the next step would be a design contract to define final designs and material selections. Cost of the design contract was $6,100 which would either be applied to the final contract amount or if either party ended the relationship at least 50% would be returned. After months of time spent on design options we provided, and working to ID material selections we received an updated final quote which was 25%+ over budget. We continued to work with them to revise scope and make changes, reaching an agreement on budget and design. After being promised to have a contract written up, and not receiving it we followed up only to be told that they had assumed changes to the design which we had not agreed to. Updated cost from agreement was more and we decided to end the relationship. they refuse to return 50% of the design contract and asked that my lawyers contact their lawyers.

    Yoder Homes was contacted by the Ganasevicis in December of 2023 with ideas concerning work to be done on their home.  *** ***** (Yoder Employee) met with the Ganasevicis at their home to discuss a variety of options.

    Based on this meeting a rough budget was proposed of $250k and an outline of the proposed scope of work.
    A design agreement was discussed and accepted by the Ganasevicis to drill down to more specifics of selection details and overall scope of work.
    Yoder Homes met the requirements of the Design Agreement, by delivering
    Permittable architectural plans to the Ganasevicis (at Yoder Homes expense)
    Cabinet designs (at Yoder Homes expense)
    Working with the Ganasevicis to determine selection details
    Provided a fixed price contract to complete the work
    Based on the upgraded selections and additions to the scope of work, the Proposed contract totaled $295,141, 18% above the projected $250,000 budget.

    With these items removed, the cost would be reduced to $257,030, just 2.8% above the original projected cost. 


    Yoder Homes reworked the scope and estimate multiple times to try to arrive at an acceptable project for the Ganasevicis.  Although many additional hours were spent on this exercise, the Ganasevicis were not charged anything for these efforts.


    It is Yoder Homes position that we have met the intent of the design agreement covering cost to produce the documents included as well as countless hours recording product selections and pricing.  No refund is due to the owners.

    I am rejecting this response because:

    the History and facts they present are not accurate at best.  The primary point of our complaint is:

    1  we dont reject the fact that we signed a design contract which came with our deposit of over $6,000.  The issue we have is that prior to signing the agreement *** was clear that if for some reason either one of us decided to not pursue the contract 50% of our deposit would have been returned.  Despite the clause that states that at least 50% would be retained by Yoder *** was clear that they were honest people.

    2  from the beginning we were transparent on our budget of $250,000 to which their original ball park came in at $247,000.  When we said we would go ahead with the entire project and after design concepts (to which we provided most if not all of the ideas and we had provided vision boards and concepts to what we wanted) and material selections (which we also consistently asked if our selections were within our budget and they always answered yes) they came back with a quote in excess of $306,000 which was significantly above our budget.

    3  items that we added that he shows below we were clear that we knew we added and we would be in agreement to pay, but the baseline project scope was the focus for us and our willingness to change scope to get the total cost back down to our budget.  We worked with *** to revise our scope, remove projects, change cabinet materials for the mud room, eliminate the conversations of bathroom which were part of the original estimate, and change flooring materials to lower costs.  After making these changes we had written confirmation from *** that our revised project scope cost would be $253,000 on August 27, 2024.

    4  *** confirmed in writing that we had an agreement and he would update the final contract and would have us a contract within days.

    5  after waiting more than a wk and following up with ***, we are then told that he had assumed we had removed a large portion of the scope of work (removed dinning room cabinets) to get to $253k based on the email I sent.  Note that the naming convention of all projects had not changed since the first estimate he provided and we had never talked about removing the dinning area cabinets.  He apologized and said that with the addition of the dinning area the cost would be an incremental $11,000 thru an email on 17sep2024.

    at this stage we came to the realization that we could not trust Yoder homes anymore for this scope of work, this was the second or third time *** said he had assumed certain elements, and we told him we had to end this and wanted our 50% deposit back.

    his reponse after wks of follow up was that I could have my layer call their layers anytime.

    i have over an year long process into this job, I have countless emails backing up the comments I am making, and at the end Yoder says they delivered on their design project and had costs they absorbed.  My question is if they believe they have delivered on the design contract why dont why have a package with the final prints, designs, and material selection details (which I dont have) or do they argue that the summary details in their builder trend appplication is completion.  I would argue its not since the data in builder trend is only useful for them.

    this is why I reject the position Yoder homes and *** are taking,  they are not stating all the facts behind their actions which forced us to end the relationship,  furthermore the statement they make that they came in a slight amount above our budget is further from the truth,  and when we had written agreement for scope of work at $253,000 they still came back with their assumptions
