    I was pre qualified by ***** ***** Bank to purchase a home with a VA loan. We found a home in Ocklawaha FL and made an offer 12/22/22and it was accepted. We made an earnest money deposit for 2K to Signature Title on 12/23/22. The home is on well water, per VA guidelines a water test must be conducted. On 12/27/22 Tim Fish conducted a water test on the property. I talked with Tim F*** and he informed me that ***** ****** (Seller) requested that the water test be performed and the cost of the test was $500.00. 4 days after the accepted offer a water test was requested. I nor my lender made this request nor was it in my contract that I would be required to pay for the test.
    Upon moving forward with ***** ***** Bank I was unable to qualify for the loan. Now Signature Title Escrow & Services refuse to refund my money in the amount of $1700.00. This is unprofessional for a company to withhold people's money when they weren't approved for a loan, let alone a water test was conducted way to prematurely. ***** *****y is the party that should be liable for Tim F*** services not me.

    Hello,

    Our office is the title insurance company that is holding the escrow deposit for this transaction. We have been notified by both buyer and seller that the transaction had fallen through. However, the buyer and seller are disputing how the escrow deposit should be released and to whom. Since there is a dispute and the parties cannot reach an agreement we are unable to release the deposit to anyone at this time. A cancellation of contract with disbursement instructions for the funds held in escrow has never been received, again because the parties are unable to reach an agreement. Until a written agreement is reached between the parties or a court order or interpleader proceedings are conducted or issued we will be unable to release the funds. 

     

    We are currently holding a $2,000.00 deposit. Mr. ******* states $1,700.00 because he does acknowledge that he owes the survey invoice. A copy of the authorization form we have signed for surveys is attached and does state in it that even a file cancels the consumer knows they are responsible for payment. He is correct in stating that there is a dispute about the water test to Tim Fish for $500.00. The seller has informed us that they will not sign a cancellation without this invoice also being paid. Again, because of the dispute we are unable to release any funds to any parties.

     

    If buyer and seller do not reach an agreement or do not initiate court proceedings, our office will at a later date submit the funds to the court for interpleader proceedings.
