    We signed with them on 11/1/2022 to have our pool cage screens replaced. Their quoted price was $4093 and asked for a down payment of $2000. We were asked to make the check out to *********************, owner rather than Suncoast Screening, **** which we did. ********************* cashed the check on 11/3/2022. Original promise date for installation was Jan. 2023. A continuing list of excuses followed, putting installation out month by month. We finally offered a date of Feb. 28 to return our down payment or install the screens. This letter was ignored by *********************. We had the screens replaced by a more reputable company and now seek only to have our $2000 down payment returned to us. And we want to go on BBB with a formal complaint to warn others of this fraud and thievery. We have just today sent notice to ********* Attorney General of this thievery

    I never gave the Stornellos a start date because of the screen shortage after hurricane ***. I ordered materials with their deposit and told them I would call them with a start date when their materials came in. I received a text message from the Stornellos saying that they had the job done by another company, and that they would like a refund. I explained to them that the deposit was non-refundable. The entire reason I have people sign a contract and pay for the materials upfront is to lock them in to the deal so they cant go with another company that offers a lower price or can get the job done quicker and then leave me stuck with their materials and paying income taxes on their deposit. I let the Stornellos know ahead of time that the deposit was nonrefundable and they had another company come in and do the work anyway. Now that they have filed a complaint against me, I will have to protect my company and myself by countersuing the Stornellos for breach of contract, slander, and defamation of character, seeing as how they called me a fraud and a thief in their formal complaint

    I am rejecting this response because: ********************* made no mention, either verbally nor in writing at the time we signed the "proposal' (not a contract) that it was non refundable. That happened only after we complained that he was months overdue from his first verbal installation date. It is obvious that ********************* had not spent the deposit money in materials, or he would have had the materials to install. Instead he sat on the money for 4 months. He has suffered no monetary damages. In addition ******* Statute ******* ****** that if the down payment is greater than 10% of the total contract price for repair, then the work must commence within 90 days of the contract. date. Failure to do so is a felony of the third degree. At this point, we don't want to have Mr. ************* pursued by law enforcement, we just want our $2000 returned, as there are really no grounds for him to keep it
