    On 8/15/25 at 845pm ******** Towing was called by HOA to have my car towed as it was parking in street which is a fight in its own as street parking is allowed between 501am-1059pm. They charged $375 instead of the legal flat rate of $125. When asked why this is they stated in ************** a new pricing format when in place allowing $125 for tow and another $275 to release a lien placed on all tows from communities. I paid and had my car with in 1 hour of them getting to their yard so there is no way a lien was placed, therefore released, within that time frame. The also would not provide a copy of said lien and/or release to show they did not place one but we still had to pay in order to get the car. I have reached out to Collier COunty for assistance as I have been told by other local tow companies that was much more than allowed. For them to have my car less than 2 hours from call to pick up and payment and becharge more than double what all others are seems illegal. Not getting a receipt or lien release for my car seems worse.

    I am the owner of Morleys Towing of Naples, ***** and I am writing in response to the complaint submitted by ****** ******** regarding the tow of her vehicle on August 15, 2025. I would like to provide clarification regarding the fees that were charged.

    Towing Fee and Timeline

    On August 15, 2025,at 9:10 p.m., Morleys Towing received a call from the communitys security regarding ********* vehicle which was parked in violation of HOA rules. The vehicle was hooked up to our truck at approximately 9:45 p.m.

    At 10:15 p.m., ************ contacted Morleys about retrieving her vehicle. She met our driver at our lot around 11:00 p.m. At that time, her vehicle had already been removed from the truck and parked in our secured lot. Contrary to Ms. ********* statement, the vehicle was not still on the tow truck when she arrived.

    Morleys assessed a flat towing fee of $125.00, which is consistent with ******* Countys approved rate schedule and in full compliance with Florida law.

    Lien and Administrative Fee

    Florida Statute ******(2)(a) authorizes a towing-storage operator to charge, among other fees:

    4. Any lien release administrative fee as set forth in paragraph (15)(a).

    Paragraph (15)(a)further provides:

    The lienor may charge an administrative fee or charge not to exceed $250 for the administrative costs associated with the preparation, processing, or execution of documents related to the release of a vehicle or vessel.
    In addition, ******(2)(b) states:

    If a towing-storage operator recovers, removes, or stores a vehicle or vessel upon instructions fromthe owner or lessor, or a person authorized by the owner or lessor, of property on which such vehicle or vessel is wrongfully parked, and the removal is done in compliance with s.715.07she or he has a lien on the vehicle or vessel for fees specified in paragraph (a).

    Because the tow of Ms. ********* vehicle was authorized by her community pursuant to 715.07,Morleys had a statutory lien for the fees listed in ******(2)(a), including the lien release administrative fee in ******(15)(a).

    County Ordinance

    Collier County Ordinance 26-229(a) makes clear that the Article does not limit any additional towing, immobilization, or storage-related fees or charges required or authorized by Florida law, which supersedes this Article. Accordingly,county ordinance recognizes and defers to the fees expressly authorized by Florida Statute ******, including the lien release administrative fee.

    Documentation

    My driver reports that Mr. ******** handed him cash for the release of the vehicle and immediately left without remaining to obtain his receipt. For your convenience,I have enclosed a copy of the receipt reflecting the towing and lien charges.

    Conclusion

    Morleys Towing acted in full compliance with Florida Statute ****** and Collier County Ordinance 26-229(a). The towing and administrative fees charged to *********** were lawful, reasonable, and properly applied. The statutory provisions confirm that once a tow is authorized, the operator has a lien that includes the lien release administrative fee authorized under paragraph (15)(a).

    12/19/2022 I invited a friend to stay at my place for the weekend. On Saturday when the property management office was closed ******** towing left a final warning on his car without any previous warnings. I called the property management company to ask how to obtain a guest parking sticker first thing Monday morning and left a voicemail. As soon as they returned the call and told me what to bring to the office we left the house to go and saw the tow track arriving. I told the guys that I am the owner of the condo and we are taking the car to go for a sticker but while one of the guys was talking to us aggressively the other one hooked up the car and they said we have to give them $65 cash to release the car. They were very arrogant and aggressive!!! I was in shock how that could be a business. That is clear scam on the edge of the low and can not be tolerated. They should give people at least 1 business day to obtain the required sticker and also if the car is not hooked it's not normal to have 1 guy confronting you aggressively while the other one taking your car.
