      We were solicited by Lifeguard Pro as a provider of Lifeguard training. Through multiple calls culminating in July, 2023, we were able to establish a cost for certifying a Lifeguard trainer, and ten lifeguards using their materials. These materials were to be accessible via user and access codes provided by **********************. After receipt of payment, Lifeguard Pro issued the user and access codes. None work for any of the initial 3 lifeguards to be trained nor the lifeguard trainer.All attempts to contact have failed. Their company advertises prompt responses but the phone used by their sales representative now answers with an automated response which allows for a voicemail. Messages have been left but not returned. Their website has a contact feature with an inoperable "submit" button.Reading their language in terms and conditions: "Non-Delivery of the Product: Due to some postal mailing or email issues of your e-mail service provider or your own mail server you might not successfully receive a physical delivery or e-mail delivery from us. In this case, you must contact us within 3 calendar days from the date of purchase or postal mail delivery, so that we can provide you with assistance. Claims for non-delivery must be submitted in writing to *********************************** within 3 calendar days from the date of purchase or postal mail delivery. Otherwise the product will be considered to have been successfully physically delivered and/or electronically delivered." There is also a "technical concern" section. Both suggest contact in three days and to not hear of a problem is to assume delivery but they have requested notifications from customers, "in writing". It is my contention that Lifeguard Pro has no intention to deliver but has constructed a business of marketing a service and being legally protected from non-delivery of a product likely not designed to fulfill customer expectations.
