    Contracted to build a deck, made a deposited on 5/29 of $8700. Lot's of rain over the summer so delays were understandable. **** continued to make excuses. Finally filed for the permit in Oct and did the framing in Oct/Nov and the project was underway. After framing was finished, gave him another $4300 expected to purchase decking supplies and continue the project. We worked with **** in Dec. and were prepared to part ways due to the lack of progress. **** never ordered the decking material because he said he needed time to pay us the refund and he didn't have the material to give to us. After consulting with my wife, we decided to let **** continue the project. He's a small business and having been in his shoes, we wanted to support him. He responded in email and was eager to finish the project.**** kept saying he would order the decking and continue work early *************** to make excuses, but did come back in Jan to finish some framing fixes based on the inspection results. Again, **** said he would be ordering the decking materials and start in a couple of weeks. Nothing has happend. **** has not responded to text, email, or phone/voicemail since January.Also, his business phone number is out of service as well. I do know he is in the area as I see his responses on NextDoor. Is pretty ridiculous as this point. I have contacted the area building department so I can cancel or transfer the permit to myself so I can finish the work. **** still owes a refund of the $4300 that was never used to purchase the decking materials. I will put $4300 in then text box below because the original payment was used to purchase materials and he completed the framing work.Unfortunately a big fault on my part is we don't have a signed contract, just emails and texts. My next step is to file a small claims court case against **** and the business.
