We signed a contract with Grizealy Construction Inc. on Sept 29, 2022 to do the majority of the building for a small single-residence new build. The contract is uploaded. By October 18th, we had paid the required 60% down - $78,000. At the end of November, they said they were almost out of money and requested another $10,000. On Nov. 25 we paid them $5,000 and on Nov 28 another $5,000. He subcontracted out the work to **** ******* with ******** ****** ********. On Nov. 29, Grizealy fired **** *******. At this point, the walls and floors are up, but no roof. He told us it was because **** is too slow and expensive and bleeding the money. **** told us that he had not been fully paid by Grizealy and planned to file a suit against him.
We then asked for all of the receipts. On Dec 7, we sat down with Grizealy Construction, and talked through all of the receipts. They acknowledged that there should be $22,748 left over from what we paid them. They stated that no longer had this money, didn't know where it went, and were broke.
They proposed to do the labor to work off this money. We would only pay for materials. We agreed, not knowing what other choice we had. Grizealy and my husband worked for 3 days putting on roof beams. The next week, Dec. 16, Grizealy had another roofer stop by to get a quote finishing the roof. Afterward, Grizealy texts us to ask if we are going to pay this other roofer. We said no because we agreed the he (Grizealy) was going to do the labor to work off the missing money. The next day, Dec. 17, they texted that they are walking off the job. We sent a letter from a lawyer requesting the money that was paid and not used to be given back. They met with our lawyer stating that they would not pay.
We also had Grizealy do a side electrical project, which was just under $1300. We did not pay this.
On January 1, 2023 Grizealy Construction Inc. changed their name to Grizealy Custom Carpentry and Specialty Services Inc.

We received your letter regarding complaint ID #********, attached.  Please find in our correspondence of the police report indicating the reason we backed off this project.  We met with ****** and her husband Dec. 16, 2022, and during negotiations, her husband made verbal threats to my husband and told us to leave and never come back, and that caused us to end our working relationship with them.  We will not work in a threatening environment.

    Most sincerely,

I am rejecting this response because:

    1.  My partner never made threats against Mr. ****** life and never told Grizealy to leave the property and never return.  Sheriff's reports are easy to file and does not make ********** statements fact.
    2. After the two-way heated argument, Grizealy texted me apologizing for the discussion getting out of hand and asked if we would pay for the third party to put the roof on.  I replied that we would not pay for another company to put on the roof because we (Grizealy and us) agreed that Grizealy would do all of the labor to pay off the missing money.   The following day, after replying that we would not pay for labor for the roof, Gizealy texted that they were walking off of the job.
    3. MOST IMPORTANTLY, regardless of any heated argument, sheriff report, or timeline of texts, IT IS ILLEGAL FOR GRIZEALY TO KEEP OUR MONEY.  If they want to walk off the job, they can.  However in doing do, they cannot keep the excess money.   That is stealing.

We went through the receipts together and they agreed there was $22,748 of missing money.  Please return the unspent money.  Make an offer.

    Regards,

Our response to this is that the customer, by submitting their response, is not representing a truthful account of the experience.  We were threatened by her partner and were told to leave and never come back.  We were there trying to make things right. End of story.

I am rejecting this response because:

It does not matter if my partner did threaten Mr. **** or kicked Grizealy off of the property forever, which he did not, you cannot keep the excess money. It is illegal.
