My elderly mother and I had to have repairs done in our laundry room/dining room/kitchen after our hot water heater leaked. The kitchen flooring was removed completely, as asbestos testing had to be done. We contacted Foundatonal Rock LLC (***** ****), hoping they would be able to install our new flooring. ***** appeared to communicate that, although he was extremely busy, he would probably be able to get to it (the job) in the near future. His father repaired the floor under the hot water heater and patched the drywall around the heater, where there was water damage. His father worked no more than five or six hours, and did a good job on the repair.

When we didn’t hear back from ***** after another three weeks, we hired another contractor to install the laminate flooring.

We were shocked, though, when we received the repair invoice from Founfational Rock, LLC! For a maximum of six hours of labor, we were charged $5,600!! Although the average hourly rate of contractors is between $50-$100/hour, we were being charged $933/hour!

***** came to our house today to get his payment and drop off the invoice (which we had already gotten from the insurance adjuster). My mom had written a check for what we believed was a more accurate total: $500 for labor, $257.12 for materials, and $1,600 contractor fee (a scam by itself) - for a total of $2,356.12.

When I tried to give this lesser check to him, he refused, stating that the insurance adjuster had issued the check for the amount he had stated was the total. When I accused him of committing insurance fraud, he repeatedly said, “It’s not insurance fraud. The insurance company issued the check, so it’s not fraud.” When I said, “I don’t know how you can sleep at night,” he said,” Oh, I do!”

Long story short, I am sickened by the greed of Mr. ****, who didn’t even do the work HIMSELF!

My advice: avoid Foundational Rock, LLC!!

      Business Response

The customer did call us about her floor. She had asked me to put her on the list for when I am not busy. at that point we were about 3 months out. The insurance adjuster called me and asked if we would fix the drywall and fix the floor under the hot water heater. Her plumber removed the hot water heater. We had an employee of Foundational Rock LLC, come out and fix the floor, repair the drywall one day. The second day our employee went out to put on a third coat and texture the drywall. We did communicate and ask when she would like to do her floor. She responded with "Did we submit a bid for the floor yet". Knowing she had to wait 2 to 3 months to get to the flooring. We never sent her a estimate for the repairing of her flooring. Once we finished, we billed the insurance for the work that was completed and for the travel cost of going back and forth. The insurance adjuster looked over the invoice and approved, paid the bill out to the customer in order for her to pay our company, Insurance adjuster never asked for us to do the flooring. The customer wrote out our check and then continued to but a stop payment on the check. She did not intend on paying her bill and wanted to keep the insurance money for herself. We did not charge her no extra money than what was given and approved by the insurance company.

      Complaint: ********

I am rejecting this response because:  Regardless of the amount approved by the insurance company, Foundational Rock charged a completely unreasonable amount for the minimal work done.  The Foundational Rock employee worked at our house for approximately five hours, at most.  Using the mileage reimbursement rate of $.70 per mile (the 2025 rate for businesses and self-employed persons), the total mileage charge would be $101.08  (assuming that the Foundational Rock employee drove from Cedaredge to Montrose, as we had been told).  According to these calculations, this would mean that after the "Contractor fee" of $1,600 and the $101.08 mileage reimbursement, the remaining billed amount would be $5,755.04.  This would indicate that we were charged over $1,100 per hour for the services provided. It is upsetting that the company owner believes that I, "Want to keep the insurance money" for myself.  I tried to offer a reasonable payment, as I understand that the company should be payed for the work done.  We only wrote another check to the company when we were threatened by their lawyer (see attached).  My only hope is to prevent other seniors from being taken advantage of by this predatory company.Regards,***** ********
