    TriSearch represented themselves as being experienced in provided talent through their recruitment services to staff government contracts requiring security clearances. Throughout their agreement with us they have not been able to provide candidates for hire who meet technical requirements for the work or who could obtain a security clearance. In some cases, they tried to provide foreign nationals. As a result, ******** has tried to force us to pay for positions they could not staff. First they threatened to sue us if we did not pay for positions they were unable to fill and then they have sent a collections agency after us requesting over $40k in payment if we do not pay for candidates they never provided. We even pre-paid 50% for positions TriSearch never provided candidates for.

    As I stated in our first response to the BBB, the matter between TriSearch and Xenith is now being litigated in Colorado state court per our binding contract with Xenith. Xenith has appeared, counter-sued TriSearch, and TriSearch has answered that pleading.

    Before discovery begins, we expect the court to direct the parties to mediate the dispute. We, of course, will obey any court order but will not agree to any settlement that does not include payment of at least the $16,250 Xenith undoubtedly owes TriSearch. Our pending claim before the court exceeds that amount and, we are expecting to amend our complaint to add to the amount in dispute other placement fees clearly owed under the parties' binding contract.

    However, those additional placement fees beyond the fees currently before the court will require truthful responses to discovery requests which we have not yet made. So, before discovery starts, Xenith still has an opportunity to resolve the dispute (as Xenith has been informed more than twice in writing) by paying TriSearch what it owes before discovery commences and TriSearch amends its complaint, thereby raising the cost of any possible settlement.
