      Nature of Complaint: Unfair Fine and Lack of Written Rule Details of the Complaint:I am a homeowner residing in a private, gated community governed by *******************. I am filing this complaint due to an unjust and unreasonable fine imposed on me by the **** The issue stems from my children riding their bicycles in the street within our private community, which the *** claims is a violation.Upon investigation, there is no written rule in the ***'s governing documents, including the Covenants, Conditions, and Restrictions (CC&Rs), bylaws, or any formal rules and regulations, that prohibits children from riding bicycles in the streets of the community. Despite this, the *** has fined me $250, citing verbal warnings as the justification. They argue that no written rule is required because I was told to stop in advance.This fine is being imposed without any legal basis or reference to a written rule, which I believe is both unfair and improper. California *** **** require that any fines be based on specific violations of the associations governing documents, which must be made available to homeowners. Additionally, I have attended a hearing, but the *** insists that verbal instructions were sufficient grounds for the fine, which I dispute.
