    I signed up for a 30 day trial membership at 360 imperial beach In ************** ***********For 30 days the fee is 30 dollars and I paid that fee. I spoke with the owner in person and explained this was a trial run to see if I could make it work with my schedule wasnt ready to commit yet. This was in response to him asking me if I wanted to sign up for a month to month. I said no, Im just going to do the 30 day trial for now.I saw the advertisements and because theres no disclaimer or mention of it being a month to month plan and based on that conversation with the owner- I signed up. I only made the classes twice as my new job is extremely demanding.I clear could not commit.To my surprise I see a charge of $169 on my account from this gym!I reached out to the owner, who I had the conversation with and explained the situation and requested a refund. He claimed his terms are clear though they only appear in terms and conditions and contradict the conversation we had and his sites advertisements. This is deceptive and misrepresenting, at best misleading! He denied my request.

    My name is *************************** and I am the operator of the Performance360 ************** location of the gym. I'm very sorry that I was not able to respond to this case because I was out of town and just got this mail from my mail box today. 

    In response to ********************************* statement that she spoke with the owner (Myself) "In person". This statement is false. We have never met in person and have only corresponded through email which I will provide every single message which we exchanged. As opposed to just the one that she sent, I will also provide her class history which shows she has never taken one of my classes., showing that we never met in person.  

    Her entire statement of "explaining this was a trial run to see if I could make it work with her schedule... etc" and me telling her something I would never tell anyone signing up for the gym is completely false. I would never tell anyone that because it is very clear and in our procedures to tell people signing up for the gym that the first 30 days are $30 and then your membership continues at the package that you signed up for. In her case, $169 Unlimited plan.

    There is no gym or membership anywhere that has a policy of "Come in for $30 for 30 days, and then we will talk about memberships after that with no commitment". 

    I believe that my screenshots of our only conversations will show that we in fact did not have the in person conversation that she claims. It will also show that she agreed to terms that she signed up for. If you would like you can also go to our website www.perform-360.com/IB and you will repeatedly see that we talk about a FIRST month of $30 days. Not a 30 Day membership.
