    I am rejecting this response because: 

    In reference to *************************** letter:

    In truth, the quality of his work is definitely very poor. He said I wanted extra work to be completed at my home at no extra cost.  That is not true. I never asked for any kind of additional work to be completed at my house. They are In fact reused wood from the old retaining wall for my project. 

    Regarding the lien:

    I did not pay him because the project was not completed. I told him that I would pay the balance after the project was completed, and then he insisted on receiving the money upfront. So I paid him and he never came back to finish the project.

    About the turn over wall at the end of the wall: 

    The original wall had turn over and he said he would make an angle like the original one. He left the turn over wall unfinished, because he said I have to buy more lumber for just small section of the wall, and also there were no trees that would to be interfere with the angle of the wall. And it was left unfinished.

    About concrete and bricks:

    The bricks and geometric-shaped concrete patio were severely damaged by the industrial, machinery during the construction of retaining wall. And he did not fix it.

    Regarding the gates:

    He said there will be gaps between the wall and the gates. He said, we will fix the gate after the wall is done. And they did not.

    Regards to awarded $500 reasons as follows:

    1) The claim was done in the early stages of the projects, problems, such as leaking bowing and etc. 

    2) the uneven upper wall was covered with a decorative cap and defects were not visible to the inspector. 

    3) I wanted to plant flowers along the retaning wall. Without my permission, they poured left over unpleasant gravel from back of the wall along the retaining wall to cover the large gap between the bottom of the wall and the ground. Therefore, The **** inspector did not see those two major problems to determine an equitable award.

    Met with ************** to discuss the wall project: 

    I showed him the wall that runs along my driveway and I explained that I wanted a similar wall behind my house. I also told him the wall along my driveway has existed for over fifteen years and is still holding it up very well without bowing, and dirt/gravel leakage or deterioration of the wall. 

     

    At the time I pointed out the following:

     

    1) I told him, I wanted the distance between the posts to be four feet apart, like the driveway wall. 

    2) I told him, drain fabric needed to be installed around the gravel and etc. like the driveway wall. 

    3) I told him I wanted the color of the wooden wall to be the same color as the wall you built in the ************** and I also showed him the photos of the wall he built in ******. He said the wall would last forever even better than driveway wall. This wall cost me a lot and was not built as I expected.

    Regarding the contract:

    I got the contract and I was charged about $50,000 based on a verbal agreement and in his contract there was absolutely no explanation of how the project would work. I repeatedly asked him to provide project specifications and he did not provide them.

    *** Clyde team built a faulty retaining wall that began to fail almost immediately and they did not complete the projects. 

    Following is a summary of the unresolved issues pertaining to a retaining wall project that i retained with the Ned Clyde Construction to undertake.

    *** Clyde team built the wall behind the house.  Following is the list of problems:

    • The base of the wall is in dirt rather than concrete so it is uneven 
    • The big gaps between bottom of the wall and the ground
    • The gravel was not wrapped around drain fabric so there is gravel between the boards
    • Some boards are cracked and bowed
    • Gaps between the horizontal wood plants of the wall which is a lot of gravel pass through
    • Upper wall the horizontal planks are not flush with ********* 
    • Wood color is not uniform
    • They did not build a box around the sprinkler system behind the wall like the original one 
    • They did not connect sprinkler system probably to make them work 
    • Turn over wall/angel at the end of the wall is incomplete 
    • The posts are six feet apart instead of four feet apart

    In addition, the workers created the following damages to my property during the construction of the retaining wall, and he did not fix them.

    • They damaged the property gates.
    • They damaged the concrete and brickwork on the patio
    • They damaged rain down-spot
    • They damage irrigation

     

    ************** the president of the company agreed to address the problems and he sent me a written repair proposal to fix the issues and the following was not included in his proposal: 

    damaged concrete, bricks, gates, sprinkler system, irrigation system, cracks boards, bowed/bent boards, and adding the boards to the end of the wall. When I asked him to include those items to his repair proposal, he did not respond or set a date for the repair. 

    I would like the Ned Clyde Construction to stand behind their work and complete the  project properly.

    ****************of the company again to fix the faulty retaining wall and he said that I needed to talk to a few people about it and he would call me back and he did not. I want him to come back and finished the job correctly. I would like to add additional info 
    to my complaint as follows:

    1-The sprinkler system was 
    part of the retaining wall and 
    needs to be repaired. 

    2-The concrete and bricks in the 
    backyard were damaged and need 
    to be repaired.
