    On December 10, 2024 a employee of Marshalls came to my house to give an estimate on gutters. ****** ***** met with him and told him where we would like to have them placed. We have a house with sloped yard where it slopes towards the house on two sides plus a set of concrete step that it slopes towards on one side. We wanted 3 of the downspouts placed in the front of the house due to the slope of the yard. On December 30, 2024 Marshalls text me(9:27AM) that they would be at my house that day to install the gutters. I text back ok, then at 10:53AM I got a text that said they was there and needing access to an electrical outlet. I replied with I work in town and would be right there. 2:45pm I got a phone call they were done and had left for me to mail the payment. I got home at 2:50PM tried to call back with no answer, then I text. the downspouts were put in the wrong spots. one is put midway to the back of the house on the slope side of the yard so the water will still be an issue with my foundation, one is put in the middle of a flower bed with the slope towards the steps, so water washing out under them will still be an issue. I text all this to **** ********, he informed me that none of this was talked about in the estimate all that was said was "water directed away from the house". (He did not do the estimate his employee did) and that's not true. It was. He said I can pay for it to be tore down, fixed, labor, and mileage. I now have two downspouts that are putting water right where I did not want water, to my foundation and heavy concrete steps. Water is still not directed away from my house if that is his argument. He spoke with ****** also about all this and kept referring back to, no one was home. we had already talked with them on December 10 during the estimate plus I had already ran home within 5 minutes of him texting me that they needed a plug in. so I feel that cant be used either. same guy that did the estimate put up the gutters? beats me

    To be clear, my foreman was the one who did the estimate. *** ***** was there during the estimate. While *** ***** did request the placement of the downspouts, my guy stated he would try, but, that with older houses, and the settling of the house, sometimes we have to position the downspouts where they will be more efficient and carry the water without run over. *** ***** stated as long as it takes the water away from the foundation, he didn’t care where they were placed. Since receiving this complaint, I have tried to contact **** ***** and given her my resolution to this on Tuesday January 14th, I have not had any response. Here is that text:

    **** *****, first, I’d like to say, I am appalled that you felt like you needed to involve the BBB with a claim against my business. When I spoke with your husband about the placement of the downspouts, it was understood that we’d wait until after it had rained to see if the water would drain the way it should. He informed me that he worked out of town and that he would check when he got home. He did confirm that he had discussed where he thought the downspouts should be located and he did say that my guy said he would try, but, was concerned about how the water would collect from the roof. Then I got an email from the BBB. So, this is what I am prepared to do. I did receive your check and I will wait to cash it. We are going to schedule to come and tear down the runs that need to be replaced with the downspouts in the locations that you want them. You or someone with the authority will need to be there at this time to approve of the placement. I will also have a document for you to sign that says we will not be held liable if/when the gutters do not carry the water to those downspouts. Your house is an old house that has a roof that has sagged over the years causing the water to not run the way it should.  This is not something we have control over. That is why my foreman elected to change the placement of the downspouts. I can assure you that we would never change the placement of the downspouts out of convenience to us. Unfortunately, we will not be able come back until next week sometime. Please confirm that you understand and agree to this
