Im seeking repayment of $24,500 for *** breaching my contract with them (signed on 10/24/22, with delivery of siding on 2/27/23, and work beginning 2/28/23) by not installing the specified Polaris WeatherTech solid vinyl siding. According to the ********************** (VSI), the solid in solid vinyl siding means that the color goes all the way through the panels (so that you wont have to worry about scrapes, or ever needing to paint it), which is how the *** salesperson I dealt with prior to signing the contract described it to me, and whats clearly implied by the brochure for this particular line of Polaris siding, too. The siding that *** actually installed is neither colored all the way through (my primary complaint), nor is it even Polaris WeatherTech siding, but either RMC Fairfield or HOMEX Alpine Ridge (per the sticker labeling on the cardboard boxes it came in, neither of which say Polaris). Im also seeking $4,532.56 I had to pay a second (BBB accredited) contractor to fix multiple problems caused by poor *** workmanship. Although some of these issues were part of the punch list I provided *** before a final walk though, their lead worker ignored the majority of them before deciding he had done enough. *** then offered two new workers to finish for him before I made my final payment (because I didnt want them to put a lien on my house, and before I figured out that they breached our contract by using a different brand of cheaper quality vinyl siding), but I had lost all confidence in them by then.I reached out to *** prior to writing this complaint and gave them 3 weeks to offer a reasonable resolution, but theyve so far denied any wrongdoing, erroneously insisting that they installed precisely what I contracted with them to purchase.
