I moved into ***************** Village of ************* (continuing care retirement community) on November 2021. The entrance fee was $297,400.00 plus a monthly rental fee. The entrance fee is an insurance policy to be applied to long term care should I have required it. Planning to stay there the rest of my life, I agreed to the terms and conditions of their contract. The only thing I didnt agree to was to live in unsanitary conditions with rats, roaches, ants, termites and millipedes. Since ***************** was not able to eliminate the infestations, I requested to be moved to another unit but I was denied. My only option after 10 months of struggles was to leave ***************** Village and to seek other living accommodations outside ***************** Village. I requested the full refund of the entrance fee because they couldnt provide me with a safe and healthy place to live.Instead of doing the right thing and refunding my entire entrance fee, they reverted to a clause in the contact allowing them to penalize a person for just wanted to leave. So they calculated my departure refund as if I wanted to leave, not because I was forced to leave. They withhold $75,246.27 (5% of the entrance fee plus 2% of the entrance fee per month for ***** months).
