On January 15th, 2009, Mpell Solutions entered into a “fulfillment agreement” with Active Response Group Inc (ARG), to act as the fulfillment center for ARG certificate redemption. Per the agreement, Mpell Solutions “is under no obligation to fulfill certificates redeemed by customers until Buyer (ARG) is current on all outstanding invoices and in fact obligation remains with Buyer until all outstanding invoices are paid.” This agreement was terminated on April 23, 2009. Consumers have received correspondence directly from ARG, claiming the company is ceasing operations and is unable to fulfill their certificate redemption obligations to their consumers. The BBB has been unable to locate a filing with the US Bankruptcy Courts. If you are a customer of Active Response Group and having difficulty redeeming your certificates, you may wish to contact the New York BBB to file a formal complaint against ARG, in addition to contacting the New York Attorney General’s Consumer Fraud Bureau at (800) 771-7755.
