Failure to show up to complete the remainder of the project (block wall installation, gate installation. Minor stucco, paint fence) on Monday May 22, 2023 phase 2 (install gates and paint)They were supposed to install the 2 gates in backyard and complete the painting portion of the block wall they installed. We arranged and agreed on Tuesday May 9, 2023 @ 8:28 AM after stucco cured to paint and install of the 2 gates on Monday May 22, 2023 **** told me a second time they would show up on Tuesday May 23, 2023 to complete the paint and block walls and did not show Later that day on Tuesday May 23, 2023 **** said they will not come out unless paid in advance. That is not what our contract says. He is trying to change the terms of the contract and purposefully delaying the project I suggested I could get a quote to paint since he was once again complaining about paint matching and adding wording to the contract in an email of which I did not agree with. Since he was attempting to change the terms of the contract in an email of which I did not agree with and was untrue my suggestion was to let me hire someone else to do the paint portion since they didnt even know how to paint match. The last day of the job his worker asked me repeatedly how he can match the paint? I asked him who is painting they must know how to do a paint match? I suggested taking an existing piece to match the paint cause he kept stressing about it even though HE WAS NOT THE ONE DOING THE PAINTING he told me. Changing the terms of the contract that was signed on 4/14/2023 today by sending me yet another email on Tuesday May 23 saying he will not come to hang the gates or do the paint until I pay in full in advance before they start the work. I reviewed my contract again today and it clearly says 50% deposit, 50% upon completion. IT DOES NOT SAY PRIOR TO COMPLETION. He told me he would show up a 3rd time on Wednesday May ************************************************** advance.
