On April 18, 2023, the business entered into a Consent Order with the Minnesota Department of Labor and Industry (DLI). The Consent Order settles allegations that the business violated Minn. Stat. 326B.082, subd. 11 (b)(5)(8)(9) and 326B.84 (2)(4)(5)(15) (2022). Under terms of the Consent Order, the business agreed to be prohibited from offering anything of value to offset a consumer's insurance deductible or to offer to compensate a consumer for providing a service such as marketing credits, sign credits or referrals. The business further agreed to be prohibited from door-to-door solicitations unless they have complied with local requirements and to ensure compliance with all statutes, rules and orders over residential building contractors, remodelers and residential roofers. The business also agreed to be prohibited from beginning insurance-funded work until the owner has been provided a written estimate and reach an agreement for the scope and cost with the owner's insurance company. In addition, the business agreed to be prohibited from offering or providing adjuster services, having a direct or indirect relationship with an appraisal firm and to not require a property owner to have an appraisal or compensate the business for negotiating with an insurance company. The business agreed to complete the work as listed in the written contracts and changes orders and have all required inspections; ensure all communications, including invoices, are accurate and reflect the scope of work completed, along with documentation for expenses if requested by the consumer or insurance company. The business agreed to pay the stayed penalty of $8,000.00 from a 2017 Consent Order and to pay $2,000.00 of a $10,000.00 penalty with the balance stayed on the condition that the business fully complies with the terms of this Consent Order and has no future violations of any law, rule or order under DLI authority.
