    Mr. ******************** replaced a second story deck roof on my condo building which required removal and replacement of flashing and windows. The stucco around the flashing and windows had to be removed. Mr. ******************** required that ********* the stucco topcoat and Mr. ******************** reapplied the stucco topcoat. However, Mr. ******************** crews did not follow the topcoat manufacturer's application instructions. The result is the stucco was applied incorrectly and looks disturbingly different from the other stories on the facade of the condo building which can be seen in the attached photos of the original stucco and the stucco applied by Mr. ********************.Two professional stucco companies and the manufacturer have looked at the workmanship and declared it completely unacceptable. Their recommendation was to remove all the Mr. ******************** installed stucco and refinish the 2nd story at a quoted cost of $10,000. I have invested 14 hours labor and $200 in material just to remove the stucco.I corresponded with the Mr. ******************** project manager and agent, Mr. **************************** in August, 2022, October 2022, January 2023, March 2023 and now six times in April 2023 . **************** has promised in each of the many, many, correspondences over the last nine months to settle the stucco damages pending approval by the owner. On April 10 2023, **************** agreed to $500 payment and removal of construction debris/junk from the condo garage as a mutually agreed settlement for the incorrectly applied stucco. Mr. ******************** has failed to honor this settlement.

    We needed to cancel our roofing project after we put down payment. I am ok with giving up the down payment but Mr ****** wanted additional money for services that were not rendered and materials that were not delivered to the job site. Home owners beware: the state limits advance payment at the time of contract signing to 10% of the total estimated job cost or $1,000, whichever amount is lower! All payments thereafter are supposed to be made for work performed or for materials delivered to the job site. To make things worse, they hired a lawyer to attempt to collect additional money for services not rendered and materials not delivered to the job site. They didn't have the courtesy to call me back again to work out the problem. If this is how they treat customers, I will never use them for roofing!

    We expected this social media campaign by you in retaliation for holding you accountable for breaching our signed agreement dated 9/11/2020. We are not surprised at all at your attempted retaliation of which we feel is unfair and unreasonable. We don't take our commitments lightly and we will seek legal rights and legal remedies to protect our business. We have an agreement signed on 9/11/2020 and we proceeded in good faith to execute the agreement. We paid for materials, we paid for scaffolding, we paid for a permit, we scheduled your work and saved a spot on our production calendar, we communicated with you about start dates and you postponed 5 times for various reasons. We accommodated your requests each time. We aspire to 100% customer satisfaction and we have bent over backwards to accommodate you. After 7 months you wrote to us to cancel your contract because you hired a different contractor to do your roof. The reason a contract exists is to protect both sides. We have honored our commitment to you and you have breached our agreement after we worked diligently to perform the agreed upon work. We are ok with canceling the agreement based on the terms of the signed contract. By breaking our agreement you are putting us in unfair position of not being able to recoup expenses we made and lost opportunity costs for holding space open for you - it has been tough enough doing business during a global pandemic. We invite you to accept our settlement proposal and move forward to resolve this amicably. Please respond to our proposed settlement by 6/9/2021 at 4pm.
