Most complaints in our BBB files concerning this business are from consumers the company has contacted in an attempt to collect fees and repayment for a payroll advance or check cashing transaction that they determined was not repaid on time or was not repaid in full. These complaints generally allege the firm's collection practices were questionable because: collection activity was unwarranted while the transactions were disputed; because the company contacted customers at work; because the company contacted customers early in the morning and late at night; because the company made a number of repeated calls to customers; because of the language and demands made by the company when contacting customers; because the company contacted persons other than the customer; because additional checking account and banking fees were incurred by customers when other personal checks "bounced" or account actions were rejected for insufficient funds after Checksmart automatically withdrew loan payments from the customer checking accounts; because the company continued collection activities after customers determined they had completed loan and fee repayment. CheckSmart sometimes responds saying because they are not a third party debt collector, but collecting their own debts they are not subject to the Federal Fair Debt Collections Practices Act. At other times, the firm has responded by stating their position in rebuttal to the challenges, including referring customers to the terms and disclosures of their loan application and agreements. Checksmart has offered adjustments to some customers.
