In June 2020, I entered into a contract to have Elite Spas construct a 8' x 18' swim spa and 8' by 8' hot tub in my back yard. Both were to come with insulated covers so that they are useable year-round.On March 19, 2021, they completed the installation of the swim spa cover and I paid the final invoice amount of $8,304. That same day, I let them know that the pool cover was not working. They worked with their supplier to rebuild and replace it once, but upon installation it was clear that it was still not functioning. As of 11/30/2022, after multiple communications with this company, the defective cover still sits on my pool. It cannot be opened or closed, and it is so heavy that it has ripped the heavy marble stones off of the wall. After 18 months of complaints, they told me they will remove the cover and refund the cost of it, leaving me with an uncovered pool. However, this was not our agreement and obviously I would not have contracted for them to build an uncovered pool in this climate. That is not feasible nor useable. For nearly two years, I have been left with an uncovered pool that is rarely useable because of the exorbitant cost of keeping a heated pool uncovered for much of the year in this climate.I have requested that they refund the cost of the swim spa cover. I have also asked for interest charges at the interest rate specified in their contract based on the fact that they should not have collected my final payment since they did not finish the project, in the amount of $2,242.08 (as of Oct 15). I also requested that they reimburse me $1348 in loss of use, which is 6% of the cost of the fiberglass pool, based on the loss of 18 months of pool usage against an expected 25-year lifespan of the swim spa shell.They have responded that they will refund only my initial cost of the cover, and they are forcing me to agree in writing to the cancellation of the rest of the contract before they will remove this cover from my property and refund me.
