Government Actions

State of West Virginia Attorney General Patrick Morrisey vs Glenn A Naylor II d/b/a/ Naylor Monument Company, LLC, Naylor Monument Memorial Sales, and Naylor Monument Company

The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below. 


On July 9, 2024 a request for admissions and summary judgement was granted by the Circuit Court of Kanawha County, West Virginia against Glenn A. Naylor, II, d/b/a Naylor Monument Company, LLC, d/b/a Naylor Monument Memorial Sales, and d/b/a Naylor Monument Company. The summary judgement states the Defendant engaged in unfair or deceptive acts or practices by advertising memorial construction, engraving and installation services with the intent not to sell them as advertised, failure to complete contracts as represented, failure to provide, or substantially provide, goods and services as promised in the Defendant's contracts, using false promises to induce West Virginia consumers into purchasing memorials or engraving services, and misrepresenting to consumers when memorials would be delivered and installed.


The court ruled the Defendant is banned from operating any memorial business in West Virginia and ordered the Defendant to offer full refunds to all consumers who purchased goods in response to the unlawful solicitations, and pay the full cost of the consumer refund program. The Court awarded the State a judgment in the amount of $78,851.44 to be paid to aggrieved consumers. The Court also imposed civil penalties of $5,000 per transaction or consumer victimized, in the total amount of $125,000.00.

On June 16, 2023 the West Virginia Attorney General Patrick Morrisey filed a lawsuit with the Kanawha County Circuit Court against Glenn A. Naylor II d/b/a Naylor Monument Company, LLC, Naylor Monument Memorial Sales, and Naylor Monument Company for violating the state's Consumer Credit and Protection Act. The Defendant is accused of failure to complete orders, deliver, or install monuments after consumers have paid for the service and  failure or refusal to answer consumer's telephone calls or messages regarding delays. Some consumers indicated the monument was eventually delivered, but was incorrectly engraved and the company refused to fix or replace the monuments. The lawsuit seeks to enjoin the Defendant from engaging in the sale of any cemetery monument or service of any kind in the State of West Virginia, pay restitution to all aggrieved consumers, seeks judgement in favor of the State and order for the Defendant to pay a civil penalty of $5,000 for each and every willful and repeated violation of the Consumer Credit Protection Act, as well as pay the State of West Virginia attorney fees, court costs, investigation costs, and all other costs associated with this action.
