Consumer Financial Protection Bureau v. All American Check Cashing Inc.
The Consumer Financial Protection Bureau filed a lawsuit in US District Court in Jackson on Wednesday, May 11, 2016 alleging All American Check Cashing, Inc. "instructed its employees not to tell customers what fees they were being charged and that the company overcharged some customers and didn't repay them.
In July, 43,647 consumers harmed by All American Check Cashing, Inc., will begin receiving refund checks in the mail.
The CFPB took action against the check cashing and payday loan company All American and its owner, Michael Gray, alleging that All American failed to disclose the cost of cashing a check and used deceptive tactics to prevent consumers from canceling or refunding a transaction. The CFPB also alleged that All American made deceptive statements about the benefits of high-cost payday loans and failed to provide refunds after consumers overpaid their loans.
As a result of the lawsuit, the CFPB will distribute $8,048,477.02 in total payments to consumers through its Civil Penalty Fund. The payments will be mailed on July 30, 2024, through Rust Consulting.

The state Department of Banking and Consumer Finance is examining possible illegal practices at a Madison-based payday lending company.
The department issued a cease-and-desist order on June 19 to All American Check Cashing Inc., which has 51 locations in Mississippi. The order alleges the company illegally charged customers extra fees and refused to hand over business records to department examiners as required by law.
According to the order, the department obtained a document detailing the company's "Monthly Lending Program."
"It (the program) specifically instructs employees to accept only the fee (interest) on a delayed deposit check and further instructs them on how to illegally 'roll' a check during the middle of each month," the order states.
