On September 5, 2024, BBB requested Ruths Gems to modify, substantiate, or discontinue claims made on their website (https://www.ruths-gems.com/) that read, "Timeless Craftsmanship, Unmatched Quality.", "Ruth's Gems is an American jewelry brand...", "Each piece is created in my Arizona studio...", "30 day returns Doesn't fit? - No problem! You can return or exchange it within 30 days.", "The best quality...All my jewelry is carefully crafted from high-quality materials, ensuring they last extra long.", "...I’ve been creating handcrafted jewelry in my cozy studio in Arizona...", "My journey with jewelry began in a small, sunlit studio nestled in the heart of Arizona.", "4 ITEMS 25% EXTRA DISCOUNT", "5 ITEMS 30% EXTRA DISCOUNT", "...I say goodbye to my beloved jewellery studio...I'm having a mega sale! Take advantage of extreme discounts up to 80% while supplies last...", "Ana B. and 1,767 others are crazy about my jewelry", "Low stock - (#) items left", "All items are made from 925 Sterling Silver...", "Ruth's Gems® exclusive jewelry store will soon be closing. These handcrafted, high-quality pieces are available at a temporary discount of up to 80% as we prepare to close our store. Take advantage of this limited-time offer while supplies last.", and had the original prices crossed out with a new lower price published, and had published Trustpilot customer reviews with a 4.7 star out of 5 star rating, based on 1,067 reviews. Additionally, on the company's Facebook page (https://www.facebook.com/profile.php?id=61561090234070) it reads, "Ruth's Gems is an American jewellery brand..." Advertisers must be prepared to substantiate such claims per BBB's Code of Advertising.
BBB's Code of Advertising Section 1 states, The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB. Additionally, BBB's Code of Advertising Section 37 states, “Made in USA” and similar terms used to describe the origin of a product must be truthful and substantiated. Additionally, BBB's Code of Advertising Section 3 states, The former price must be the actual price at which the advertiser has openly and actively offered the product or service for sale, for a reasonably substantial period of time, in the recent, regular course of business, honestly and in good faith. 3.2 Where the former price is genuine, the bargain being advertised is a true one. If, on the other hand, the former price being advertised is not bona fide, the bargain being advertised is a false one. 3.2.1 For example, where an artificial, inflated price was established for the purpose of enabling the subsequent offer of a large reduction, the consumer is not receiving the usual value expected. In such a case, the “reduced” price is, in reality, probably just the seller's regular price. Additionally, BBB's Code of Advertising Section 9 states, The unqualified term “sale” may be used in advertising only if there is a significant reduction from the advertiser's usual and customary price of the products or services offered and the sale is for a limited period of time. If the sale exceeds thirty (30) days, advertisers should be prepared to substantiate that the offering is indeed a valid price reduction and has not become their regular price. 9.2 Time limit sales must be observed. Additionally, BBB's Code of Advertising Section 11 states, Where a savings claim (for example, “save up to 40%”) covers a group of items with a range of savings, the number of items available at the maximum savings must comprise a significant percentage, at a minimum 10%, of all the items in the offering, unless local, state or provincial law requires otherwise. Additionally, BBB's Code of Advertising Section 10 states, Emergency or distress sales, including but not limited to bankruptcy, liquidation and going-out-of-business sales, must: 10.1.1 Not be advertised unless the stated or implied reason is a fact; 10.1.2 Be limited to a stated period of time; and 10.1.3 Offer only such products or services as are affected by the emergency. 10.2 Where the advertiser states that it is going out of business or closing down, it must actually be going out of business or closing down. Where the advertiser is not going out of business or closing down, it can advertise that it is “selling out” a product or “closing out” particular merchandise, as long as that advertiser will no longer carry that product or merchandise. 10.4 If such sales exceed ninety (90) days, advertisers must be prepared to substantiate that the offering is indeed a valid emergency or distress sale.
