BBB Warns: Online Retailer of Popular Funko Pops Receives Complaints Regarding Non-delivery

November 21, 2019, Dallas, Texas -- Better Business Bureau Serving North Central Texas is warning consumers about an online retailer advertising custom Funko Pops, which are popular vinyl figurines and bobble heads. Consumers allege that the online store Legendary Gift For Him fails to deliver customers’ ordered merchandise after processing their payment. Legendary Gift For Him received 48 complaints in 2019. The business failed to respond to 27 of those complaints, contributing to its current “F” rating.

Nearly all the complaints against Legendary Gift For Him allege that customers found the website through a Facebook ad for a custom Stan Lee Funko Pop, which Legendary Gift For Him claimed to make in-house. Customers claim that when they placed their orders in December 2018, many were hoping to receive the product by Christmas.

“We want customers to be aware when shopping online that there are possible pitfalls,” says Phylissia Clark, VP of Public Relations and Communications for Better Business Bureau serving North Central Texas. “Tempting ads will be appearing everywhere during peak shopping seasons throughout the year. Please be on guard and learn from this example.”

Weeks passed and customers had not received their merchandise. One New York complainant told BBB, “There is no phone number listed on site, so I cannot call about my order. I have sent multiple emails to the company, and get no response.” When complainants did hear back from the business in January and February of 2019, the response was an automated email claiming that the business had been backordered over Christmas.

“Because this product is a custom limited edition, we only produce 500 items and worked very hard to deliver them in time for Christmas,” Legendary Gift For Him wrote in their email. “However, the number of orders increased rapidly. Therefore…we have decided to produce 1000 more items. But because it was so close to Christmas, we could not produce and deliver it before Christmas. The estimated delivery time and tracking number will be sent to you in the next email.”

A complainant from Texas expressed dissatisfaction with Legendary Gift For Him’s response. The complainant suggested that at the time of the purchase, “there was no indication that this was a pre-order.” He stated, “I was also concerned with the grammar because this company is supposed to be located in Utah, but it appears the person who sent it used a translator.”

Customers told BBB that Legendary Gift For Him’s auto-generated emails promised to send customers their order tracking numbers by February 25th, 2019. However, several customers told BBB that they never received the tracking numbers, the ordered products, or any further correspondence from the business. One Washington customer complained that the website still listed the product as in stock and for sale, even though his order was never shipped.

Customers who did receive their order after months of waiting reported that the products were damaged and did not match the photos on the website. A Washington customer alleged, “The package was shipped from China, which I have read typically means that it's a knockoff Funko Pop.”

The BBB Serving North Central Texas attempted to contact Legendary Gift For Him regarding several concerns. The business, which claims to be operating out of a residential area in Texas, did not respond to BBB’s correspondence.

BBB Warns Consumers:

(1) Always check the security certificate of the website when you are entering credit card information online. If the domain is not secure, your information could be compromised.

(2) Always use a form of payment that has fraud protection. Credit cards are generally a safer bet than using debit cards for online payments. Credit card companies will often provide refunds in the event of fraud.

(3) Report any problems to Better Business Bureau and Federal Trade Commission. Visit bbb.org to file a complaint. Visit FTC.gov to provide this information to FTC.
