Entered into a contract on March 6th 2023 for two hearing aids. Total price was $7000.00. Gave business $1000,00 towards payment. Four days later I called to inform them that I would have to stop the order because on further review of our finances we could not afford it. I was informed that the order would be stopped but that a %10 fee would be taken from the total price which would be $700.00 for a "restocking fee". The hearing aids had not been received by the business and I had not taken them into my possession. The contract does not say that there would be a "restocking" fee for cancelation. The contract does say that a fitting fee of %10 may be charged, but the employee only said "restocking fee" would be applied which again, is not in the contract. My position is since I never took possession of these hearing aids I should be refunded the $700.00. The fitting fee which I believe is very vague also since I assumed it was when the aids were fit to me on delivery. Thank you for helping me resolve this.
