Insurance broker switch me from Geico to Progressive. Then received a $3,100 check from ***** saying they never closed my account and it went to collections. Should still have collections paperwork to upload at a later date. Was told it was being handled and nothing ever happened

    Business Response

    Date: 08/09/2024

Thank you for the opportunity to address this concern.  Unfortunately, our client, ************************** has not been honest with you, the BBB.  He also has misdirected his issue to my agency.  We are an insurance broker and not an insurance carrier.  His issue is with the Carrier Safeco, not with my Agency, as the Carrier is the one who has placed him in collections, and after the explanation we are providing below, I am sure you will agree that ***************** is the party who has been dishonest, taken money that is not entitled to him, has elected to keep it (illegally) and deserves to be sent to collections .  Here are the Facts of this situation:

The client was insured through Safeco (Not Geico as he states in his complaint).  He asked his policy to be re-written into another carrier (Progressive).  An ***** 35 was signed by ***************** on 3/21/2024 to retro cancel his policy with Safeco (Policy # H2519064) on 2024-03-11.  The form was sent to ****************** well before the cancellation date, however, it took him several days to sign the document via docusign.

The cancellation request was forwarded onto Safeco.  A processing clerk at Safeco mis-keyed the cancellation date with an effective date of cancellation 3-32-23 instead of 3/21/2024.  This resulted in Safeco erroneously sending a Refund to ****************** from 3-23-2023 instead of the 3-21-2024!  ****************** was sent a check from Safeco in the Amount of $3147.65 when it should only have been for $1237.72.  He was overpaid by $1909.93 by ******.  ****** sent correspondence to ***************** explaining the error and requested he return the funds immediately.  ***************** refused to return the money and elected to keep it for himself, which is **** to theft!  My office spoke to ***************** multiple times, however, he is not someone who wishes to return the money that he received.  Instead he has elected to keep the money (illegally) and ******'s response is to send him to collections.  They initially sent the total amount, however, at this time have amended it to the proper amount of $1909.93.  If ****************** wishes to favorably resolve his credit concerns, he should do the proper thing and return the money that does not belong to him.

This is just as if money was deposited into one's bank account by mistake.  That doesn't mean the person is entitled to it and is permitted to keep it.  ****************** has demonstrated that he lacks integrity, and cannot be trusted to do the right and correct thing.  He has been dishonest in this complaint and has stolen from the Carrier.  Additionally, this has nothing to do with my agency, and his complaint against my staff and agency is unwarranted and invalid.  We properly completed the cancellation on ***** 35.  I have copies of the executed form, however, due to privacy laws, ****************** would first be required to give his consent for us to share that document with you.

It is true that Safeco misread and miskeyed the cancellation date and erroneously issued a refund far in excess of what was owed to *****************.  However, ****************** was advised not to cash the check and not to spend the money that was not entitled to him.  He disregarded this advice, and now has found himself in a predicament which he alone is responsible for and alone can solve.

I would refer you to Safeco for further comment on this issue with ****************** - at ************.  I would appreciate this complaint being closed with a favorable resolution to my Agency (Jerry Hallman Insurance Agency **** as we are not the party involved, only the broker that facilitated the cancellation on ********************** behalf by providing Safeco with the ***** 35.
