    On 10/18/2023, I signed contract with business owner ******, and paid deposit to hire Longhorn Foundation Solutions to replace a retaining wall. ****** and his crew have performed very poorly and unprofessionally in many ways:1. They started 30 days passed originally agreed date, didn't work continuously. After their last show-up on 12/11, they never came back to complete the work. 2. They ignored my multiple inquiries and reminders about installing drainage according to contract, and insisted on pouring concrete without leaving spaces for drainage pipes and backfilling.3. The concrete wall they poured was not vertically straight. It's leaning outwards, and won't last its purpose of retaining.4. ****** has pressured me to make payment all the time, and threatened to drop the job.5. After I confronted him that he failed to fulfill the terms of contract to install drainage, he refused to come back unless I make more payment.I've paid him 50%. I have been withholding the 3rd payment, because ****** and his crew have cut corners, failed to comply with the contract terms, and the retaining wall built is tilted outwards I officially demand Longhorn Foundation Solutions to perform the contract timely and comply with industry standard. The following wrongs need to be addressed and resolved before I make the 3rd payment:A. The outward-leaning wall need to be corrected or remedied, in order to serve its purpose of retaining B. The corners you've cut before concrete was poured need to be completed. They are in the scope of our contract, but you omitted them before you poured concrete: B.1: Install 2" PVC drainage pipes through the wall. B.2: Excavate for backfilling. You should have put forms to leave space behind the wall before you poured concrete. B.3: Install two 4" PVC pipes underground for roof gutter drainage.

    Hi ******, we apologize for the inconvenience. We couldn't continue with the project, because of incompletion of payment. We agreed to four payments throughout the project and those requirements weren't met. We we're asked to put gravel for drainage purposes, we couldn't put gravel before the wall was built, how you insisted. That was the final step to complete the project, because the retaining wall was needed to keep the gravel in place. If you believe the retaining wall was built incorrectly, we encourage you to get an engineer to review the project.

    I am rejecting this response because:

    The reason I was withholding the 3rd payment is because you have cut corners,  failed to perform the contract terms, and the retaining wall you built is in shoddy quality.  I officially demand you to perform the contract timely and comply with industry standard.  The following wrongs need to be addressed and resolved before I make the 3rd payment:
    a. The outward-leaning wall need to be corrected or remedied, in order to serve its purpose of retaining
    b. The corners you've cut before concrete was poured need to be completed.  They are in the scope of our contract, but you omitted them before you poured concrete: 
    b.1: Install 2" PVC drainage pipes on the wall.  You said you will drill ***** holes through the 10" thick concrete to install drain pipes on the wall, instead of installing them before you pour concrete.  It doesn't make sense to anyone why you would choose the troublesome (and potentially damaging) patch when you have choice to do it in the right order. 
    b.2: Leave space for backfilling gravel.  You are right that the gravel comes after the wall.  However, you should have put forms to leave space behind the wall before you poured concrete.  Now you are telling me you will dig a trench behind the whole wall to install gravel.  How much more labor would that cost?  Would I trust you to do that after I pay you another big payment? 
    b.3: Install two 4" PVC pipes underground for roof gutter drainage.  Again, this should have been done before you poured concrete.

    You have been denying the wrongs you and your crew have made, and you've been pressuring me on payment despite your failure to perform the contract. It appears you just want to pour the concrete anyway, so you can collect the big payment.

    I'm sorry to inform you, but we did not cut any corners on the project. We're happily willing to finish the project, however the third payment wasn't received to continue. We understand that there are some on-going concerns over the project, in spite of the overall project not being finished. We're willing to finish the project, once the third payment is received. If you're not happy with the work presented before the fourth payment. We will do a walkthrough of the issues that you may have and resolve them before the last payment is given.

    I am rejecting this response because:

    The contractor's response failed to answer or address my concerns and requests.

    Again, you (******, Owner of Longhorns Foundation Solutions) continue to pressure me for payment, despite the fundamental fault (wall tilting outward) of your job, and your suspicious insistence of doing the job again common sense and industry standard practice.  I suspect your motive behind is to collect as much payment as possible before you drop the job.

    I'd like to add 2 more facts to my original complaint:

    1. You were not present when your crew poured the concrete on 12/11.  You refuse to come to see it afterwards.  It appears you don't care of the quality of the job, but only my payment.

    2.  On 12/11 when your crew were pouring concrete, their form collapsed.  In order to hold the form, your crew placed 8 wood posts against the neighbor's fence, without permission from me nor the neighbor. See attached picture.  When I notified you on 12/15 of the neighbor's complaint and the risk of damages, you refused to come back to remove them.  I had to hire a handyman to remove them.
