Perry Homes is not meeting their warranty obligations that was promised under a 2 year *************** Warranty. We still have outstanding warranty claims that have been well documented that they refuse to fulfill as they state they are non-warrantable but provide no explanation as to why in their agreement. They solely state that they have gone above and beyond in their mind to fulfill their obligations. We have spend almost 2 years dealing with Warranty items in a brand new home that should have been completed prior to close according to their President of Division 3 in ******. The warranty claims fall under poor workmanship and construction defects that have been documented throughout the two years. Their company is not standing by their warranty and therefore this is false advertising and also exhibiting deceptive business practices. Employees of their organization have clearly lied about items that should have been done on the home and never were and have several instances when this has been the case throughout the two years.I have sent certified e-mail to CEO of company for resolution and to date nothing has happened.Business Response

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.Perry Homes never has validated why something is not warrantable. I have listed specific warranty codes within Perry's Limited Liability that apply to my complaints. They refuse to acknowledge legitimate warranty requests that have been called out since closing on our home in July 2022. In addition, I have attached a grade certificate that I paid for out of my own money to prove that there is not positive flow with the drainage on my property. The grade certificate will show several areas are flat (86.2 in multiple areas and 85.3 in multiple areas where water will stand and not flow). This will apply specifically to the drainage issue. I have dealt with this for over two years and Perry just keeps pushing this off and wasting my time and money for something that should have been completed over 2 years ago prior to moving in.

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.
Perry Homes merely updated the original letter sent regarding the complaint on July 26th and provided no additional information to further provide closure to my complaint. This response is indicative of Perry Homes and their overall business practices. As I stated earlier, no one from Perry Homes can clearly identify where in their Limited Liability agreement nor why items specified in my complaint are non-warrantable. In my last communication, I provided a grade certificate of my property that shows there is not positive flow of water on the side of my home. Their warranty and project managers clearly have stated that there should be positive flow to prevent water from standing for more than 72 hours on the property. One of my complaints calls for French drain to be installed and run to the street to prevent standing water along my fence line. Even Perry Homes vendor "Lawn Liquid" stated that a French drain is needed to address the issue and submitted me a quote to have this completed.The above is just one example of the inability of Perry Homes to provide any specifics as to why something is not warrantable even when the homeowner provides evidence to prove the warranty claim is legitimate. They just verbally refer to the *************** Warranty and state an item is not warrantable without any reference as to why. Then the issue continues to be unresolved until the homeowner decides to give up over time and walk away.
I have attached additional images to show the poor workmanship in some areas that I address in my complaint. You can see wood flooring lifting above the normal surface of the floor and how poor workmanship is with regards to flooring. In addition, the trim work in areas of the bathroom that have never been addressed. I have also, included images of items not in this complaint that we have avoided bothering the builder with regards to fixtures not being attached to walls appropriately. All of these just help further prove the poor workmanship and that has been a consistent issue with the home even prior to closing.
Perry Homes states in their recent letter that they have done "the right thing"? All, they have done is is pick and choose items they wish to warranty at their discretion and not warranty other items that are clearly warrantable because they personally feel as if they have done enough. I am sorry but you have a warranty agreement for a reason and and Perry should abide by this warranty. They continue to waste my time as they have for the past two years to deliver a home that is model quality that was promised prior to close by sales **** and project managers and after closing by upper management.
To this point no resolution has been offered by Perry to resolve the issues or provide a settlement which will allow me to complete the warranties myself and choose my own vendors to complete the warranties in question. I will continue to pursue these complaints and will additionally be reporting to the ************************ (***) to make them aware of Perry Homes actions in this case.

As is evident from the attached documents, there were several items which the field, our Vice President of Construction and our Division President evaluated and discussed at length, but were determined to be non-warrantable items under the Perry Homes *************** Warranty.
Perry Homes offers a 2/** warranty (two year on fit and finish items, with a ten-year warranty on the structural components of the home). Mr. ****** closed on this home (*************************) on 7/**/22, thus the two-year warranty expired 7/**/24, and the ten-year warranty will expire on 7/**/32.
The warrantable items of which Mr. ****** complained included:

As for the drainage issue of which Mr. ****** complains, it remains our opinion that the grading is sufficient and this is an issue with the neighbor to the east of Mr. ******s lot (Lot 12 Mr. ******s lot is Lot **). NOTE: THE PINK HIGHLIGHTED PORTION OF THE SURVEY INDICATES THE PROPERTY LINE BETWEEN LOT ** AND 12. THE *** IS THE **** WHERE OUR VP OF CONSTRUCTION MOVED THE SPRINKLER THAT WAS UNDER THE GUTTER THAT THE HOMEOWNER REQUESTED BE MOVED. THE ORANGE LINE MARKS THE DRAINAGE ISSUE MR. ****** COMPLAINED OF ADJACENT TO THE NEIGHBORS FENCELINE.

My house is less than 2 years old, and I can honestly say that I've been fairly happy with my Perry Home. However, as with many new homes, there were things that needed repair from the shingles, to the light fixtures and even the driveway. All areas of concern were handled with two exceptions. 1) I've noticed at least 2 nail pops in the ceiling of two different rooms. When reported the first one, I was told this was common and that i would have to fix it myself (i.e. get on a ladder, repair the sheetrock, texture, sand & repaint). After the second, I began having concerns that it could be due to uneven settling of the foundation. I would like it to be repaired & checked out for possible foundation issues. 2) The paint on my kitchen island is literally "popping" off. By that I mean, it is separating from the wood & popping off in pieces exposing the natural wood indicating there was no base coat used prior to painting. It cannot be spot painted as with normal wear & tear because it's lifting causing an uneven surface. I'm surprised that with such a reputation of producing quality homes, Perry is willing to make issues like these the responsibility of the owner, especially while still under warranty. This is my 5th new build and I have never had either of these types of things happen in a new home and in my opinion it is not a common occurrence.Business Response

We filed a warranty complaint with Perry Homes about a crack that formed across three tiles in our den. Outside opposite this crack there is are several cracks in foundation. We also have several cracks in our stucco. The home was built in 2020 and we are the 3rd owners. When complaint filed in May had been here 4 months. Perry homes sent out a person to take floor level measurements and pictures outside from Strand Inspection. I have called sent follow up complaints, asked about results of inspection and nothing no answers.Business Response

I bought a brand new home and it flooded with the first rain we lived in the house - I have pictures I can send - was told it was due to driving rain by the construction manager - less than a week later my front yard was tore up due to a drainage issue filed by my neighbors- also have pictures - walked outside and had a backhoe and there men shutting off my water without any notice - I have many more hires of someone will contact me but only was allowed to upload 2 - I am an understanding person but when you buy a brand new home you dont expect this - I have many many more concerns and issues if someone would like to reach out to me, This is in ******* subdivision in ***************** in the *************Business Response

I own a Perry home that has a cracked foundation which has subsequently caused significant cracking and damage to tiles and sheetrock throughout the home. The expansion joints have widened and there is visible cracking in the foundation. A warranty claim was filed within the 10 year warranty timeframe and I have gotten nothing but the run around and vague explanations in my attempts to have the foundation repaired.Business Response

I purchased and closed on my home end of August 2022. Since then, I have hade my entire master bathroom and guest bathroom flooded (Oct 2022) due to huge rocks/cement chunks left in the sewer, which caused damage in my home. The builder did replace the damage. I've had issues with my front door since 2023 with no resolve and it continues to get worse with the Builder (Perry Homes) and the Manufacturer of the door (Builders First Source) refusing to take ownership. The issue is two-fold. One, any slight wind blow which my house is North facing and takes the brunt of the wind, my door blows inward enough to trigger the home alarm. Anytime a storm comes through, it triggers the alarm because the door has never been adjusted and placed in properly (in my opinion). They have come in and attempted to adjust the door k*** handle I believe three times. They are coming again today to attempt to adjust the door once again. On top of that, water continues to come through the front door anytime it storms and i'm being told that I should waterproof my own door. Water is coming through the sides of the door and through the panels in the door. I have received the run around from Perry. I have asked for the builder to send the Door Installers to my home since they are supposed to be the experts and Perry refuses to do so. I'm not the only home experiencing this issue, it is a trend within the community. I have paid too much money for this home to continuously deal with these issues with no ownership on the builder for not ensuring the doors are waterproof and installed correctly.Business Response

We moved into our new Perry Home on May 8, 2023. Since moving in we have had several issues with our home but the major reason of this complaint is our roof. The roof has been prepared twice by the same contractors authorized by Perry. Each time we were assured the leak was fixed. After the last leak same location (#2), I reached out to **** D (VP of construction and explained our issue and asked for his assistance in assuring a second level of inspection was done to the roof to ensure the issue does not occur again. He said Perry project manager do not go on the roof but will ensure its done and apologized for the inconvenience. After this was done they wanted me to sign a warranty the roof was okay and I signed and annotated I am unable to verify until a heavy rain has occurred to be able to test it. Here we are today May 2024, a month after the last roof leak same place and its leaking again. Perry Homes has been reluctant to utilize a reputable contractor to oversee this work and do the repairs. Each leak has been the same company doing the repair, inspection which has resulted in the same result. This process has caused my family and I to lose time from work and inconvenienced us in all way. I want this investigated and for Perry Home to look at this missive through the lens of the homeowner. Stop sending the same repair company to fix their mistakes and continue to do subpar repairs at the expense of the homeowner. Utilize another reputable company for repairs and have a different company inspect it. Its the right thing to do.Business Response

I am writing to formally escalate ongoing concerns regarding the persistent roof leak at my newly purchased Perry Home located at ******, **. Despite multiple (3) repair attempts, and the submission of another warranty repair on May 2, the issue remains unresolved. We are requesting Perry Homes engage a reputable, third-party roofing expertsomeone whose primary role is independent roof inspection and repairto assess and resolve this issue properly. We would like this completed before any further work is performed. It is evident this issue has not been adequately diagnosed or resolved, and we are concerned that Perry Homes has not performed a thorough root cause analysis. The current approach feels reactive, with repeated temporary fixes that fail to address the core problem. Each attempt to close out the issue without sustainable resolution has been at our familys expensein time, stress, and damage to our trust in Perry Homes. We respectfully request a clear, permanent resolution with a documented root cause and next steps with pictures and evidences. At this point, we are no longer confident that this home is structurally sound or built to the quality standards Perry Homes promotes. Therefore, we are asking Perry Homes to consider relocating us to a newly constructed home of equal or lesser value. We believe this is a fair and reasonable resolution, given the extent of the inconvenience and loss of confidence in the integrity of this home. This is the letter that was sent to Sales representative Deshawn ****** & Kevin *****,President of Construction that oversees all San Antonio TX. They are retaining our Earnest money.
Dear Perry Homes Team,
This letter is to inform you that Perry Homes has breached our contract due to the neglect and poor management of the built. This has caused the home to be exposed to toxic mold during the recent framing stage of our new home on ***** ******** *** **, TX Vista Verde subdivision.
Perry Homes expressed in our contract and agreed that the home would be constructed in a good and workmanlike manner.
We walked the home today on 4/20/2024 and found many support beams and framing studs with black mold. It is evident that the mold has been in contact with the rest of home’s framing. The health hazard caused by the mold and numerous construction deficiencies noted are not acceptable.
The framing studs and beams were poorly selected throughout the home. The mount Truss Hangers were installed unsafely as well. The outdoor water spigot was forced inside the front bedroom and causing water damage.
It is already evident that customer’s health and overall craftsmanship of the new build is not a priority. After talking with homeowners in the Vista Verde and addressing our concerns with the Construction Team and today’s findings. We have lost all confidence in continuing our project. We could never move into a home that has been exposed to mold and poor built. Remediation of that toxic mold or re-construction with good quality wood, would not change our decision and trust.
Perry homes has breached the contract by utilizing faulty materials.
Contract( 5.6 Paragraph C )”If Seller fails or refuses to comply with the good workmanship of the house, the purchaser may terminate the contract and be refunded of all Earnest money.”

Dear Ms. ******:
As you are aware, you executed an Earnest Money Contract with Perry Homes for the
purchase of the Perry home located at ***** ******** **** *** *******, Texas (“the Property”) on
March 30, 2024 (the “Contract”). You had previously been under contract for the purchase of a
new Perry home in the community of Veramendi in New Braunfels and paid $6,000.00 in earnest
money funds towards the purchase of that home. When you canceled that contract, we worked
with you in the subsequent purchase of the Perry Home located at ***** ******** ***. You
executed the contract for the purchase of the ******** *** property with Perry Homes and paid an
additional $3,000.00 in earnest money. Our Division President agreed to transfer the prior earnest
money funds paid ($6,000.00) to the purchase of the Property located at Sidehill Lie, for a total
amount of $9,000.00 paid in earnest money funds.
At the time Perry Homes’ representatives walked the Property with you on 4/20/24, we
explained that the home was in the frame stage, had yet to be punched or inspected, with
considerable work remaining on the home and that we would perform the punch work for any
items needing correction.
Please note that the Perry Homes contract provides safeguards, including but not limited
to inspections of the home at various stages of completion, as well as a Perry Homes Express
Limited Warranty (including a warranty of habitability). Under the contract (see also section 3.2),
these inspection reports would have been available at your request.

3.2B. The improvements at the Property will meet the Perry
Homes Express Limited Warranty as defined below, the

Despite the home being in the early stages of construction, you made the decision to cancel
the contract, and albeit prematurely, as Perry Homes’ construction team had not had an opportunity
to assess and correct any potential issues.
Perry Homes has made several opportunities to work with the Purchaser, specifically the
transfer of earnest money funds to the home at ***** ******** ***. Second, Perry didn’t have the
opportunity to meet with you and discuss your concerns regarding the construction. Lastly,
unfortunately in this instance, the terms of the contract do not provide for a refund of the funds
paid.

Our house's patio concrete floor has the leveling issue and the plentiful waters/rains stay in the house-side (i.e. windows and the patio door) and it causes the moistures and pest issues like mosquito, wasps and so on. So the patio flooring vendor of Perry Homes stopped by our house at 03/14/2024 and did the leveling work with some concretes. The leveling work was successful and the original issue was resolved. No more waters/rains stay house-side. Next, for texturing and painting work on the patio floor, Perry Homes asked me to confirm the schedule of 03/28/2024 and I confirmed it's OK. But the patio flooring vendor of Perry Homes didn't provide the service at 03/28/2024. Then, Perry Homes asked me AGAIN to confirm the schedule of 04/04/2024 for texturing and painting work on the patio floor. I said OK! But they DIDN'T SHOW UP at the scheduled date 04/04/2024 AGAIN.For this texturing and painting work on the patio floor, at 03/15/24 , the technicians asked me to make the patio floor fully dry and clean at least 2 days. So I removed all outdoor furnitures, cleaned up, and made the patio floor fully dry over several days. However, they repeatedly kept NOT showing up! Now all our new outdoor furnitures, cushions, and ceramic charcoal grill are exposed at Texas full sun, moistures, and bugs, and getting serious damages for a long time. More serious issue is I was injured due to the repeated moving heavy furnitures in and out from the covered patio for this warranty service of Perry Homes. Now my leg(calf) muscle are injured and not recovered at all. I can't move these heavy furnitures any more. My leg injury keeps getting worse due to moving heavy furnitures. And our new outdoor furnitures keep getting serious damages. We requested the reimbursements about the damages for this, but Perry Homes said it's NOT warrantable. Perry Homes should reimburse for the damaged our new outdoor furnitures and my leg injury. They didn't show up two times.Customer Answer

After closing our new construction house which built by Perry Homes at 07/21/2022, we found extremely lots of damages, defectives, unfinished, or missing items. Totally disaster! So we requested warranty services to repair to Perry Homes. But they didn't provide the proper actions and sometimes ruined our house conditions more seriously with improper rude attitudes during warranty services. So we strongly expressed our concerns to the Perry Homes leadership including the owner and CEO about the potential warranty fraud tries or damages by Perry Homes construction staffs. Our warranty period will be expired soon(i.e. 07/21/2024) and there are still important/serious repair issues remaining. But Perry Homes keeps trying delay and ignoring our repair issues. Even if we submitted the official warranty service requests via Perry Homes Official warranty web, they don't respond at all and don't provide services at all. We extremely DO worry about our warranty period expiration without repairs. Even if we contact Perry Homes several times, they just ignore and wait expiring of our warranty period. So we submit the following complaints and requests to Perry Homes through BBB to repair our remaining warranty repair issues perfectly, 1. [Its truly disheartening to hear that issues with the paint quality cabinet durability persist. Even in areas where water exposure is minimal.
It sounds like youve had a frustrating experience with the paint quality of Perry Homes. Why these cabinets absorb water, because of poor paint quality can indeed be a significant issue in home construction. They fixed the cabinet and just one time ****, if we touched the cabinet, it looked too rough, and no glazing or anything in the cabinet or paints.
We brought some extra cabinets from ********** and fixed them in different places in our home and that cabinet showed those managers with water. It never absorbs the water and the cabinet is too glazing because of the paint quantity. This demonstration with the cabinet from ********** that showed better water resistance could serve as evidence to support your cheap quality paint. This providing a good example like this can help strengthen my case and Perry to take the concerns seriously.
We strongly believe that the paint quality is the main reason. They are not using good quality or water-resistant paint, that is the main reason.
We already talked about this issue and with those managers and they are simply blaming us because of water issues. Why is Perry Cabinet absorbing water so quickly, because of cheap quality paint, they never accept their mistake. They are very smart to blame us. Given that the cabinets are showing signs of damage within a year of closing, its evident that the quality of the paint and workmanship falls.
In this situations, its crucial to escalate our concerns to higher levels of management with Perry Homes. If youve already communicated with lower level managers without satisfactory results. Consider contacting regional or corporate office to address the issue.I can send you the pictures, there is a water tap or anything but paint is chipping. attached the pictures)
When addressing the issue with Perry Homes, be sure to clearly outline my expectations for resolutions, whether its a repaint using higher quality waterproof paint or another form of compensation for inconveniences caused.
