On 7/24 my vehicle was repossessed without notice. I was late on my payment, however I was working on arrangements to bring the account current. I was not given notice where my vehicle was to receive personal property. Calling the number provided did not send me to the repossession company that had my vehicle. My options to pay the fee and late payments were through untrusted and unfamiliar sources such as MoneyGram and ************* which required me to bring physical cash to a location. I chose to have the money sent from my bank via wire transfer but the entire process of reinstating the vehicle loan felt sketchy. All documentation requested to get my vehicle back and obtain personal belongings was submitted the same day the vehicle was repossessed. It has been 5 days and I still have not received information how to retrieve my vehicle after sending the total amount requested. I am looking for the repossession to not be reported on my credit due to the lender making payments and communication to arrange payments extremely difficult which delayed being able to make payments.Business Response

You were sent a right to cure default notice on March 24, 2025. It was sent to the address that you have on file, which is the same address that you have provided the BBB with this complaint. The letter contained the following conspicuous disclosure: "NOTE: The acceptance of these or other late payments does not waive our right to repossess the collateral or take other appropriate action if you fail to make future payments on time. You are required to make all payments on time. Furthermore, prior to referring the account for repossession, numerous attempts were made to contact you using the same telephone number and e-mail address that you have provided the BBB with this complaint. These calls and e-mails went unanswered. The repossession referral occurred on 7/21/2025. The account was over 80 days delinquent when repossessed. We do not believe that a reasonable consumer could have believed that the account could become 80 or more days delinquent after receiving a prior right to cure default letter and strict compliance notice, and not be subject to repossession. You were issued the Notice of Right to Reinstate on 7/25/2025 and we provided you the reinstatement information and location via e-mail yesterday. We will fulfill our duty to furnish accurate information to the *************************** and do not believe any unlawful act occurred by First investors in this matter. Especially considering that none of Pennsylvania's laws or regulations applicable to unsecured and personal property secured lending provide a debtor with a pre-repossession right to cure, but we provided you one per our policies.

I financed a car on loan **************** for the amount 15.681.42 on a 30 month term. Today this date the car has been repossessed in the last 2 weeks for auction. I paid EST 22.551.04 as I made 64 full payments I still have a balance of owing ******* and a last due of $1394.00. I have offered to settle the amount during tax season they refused I have paid doubled the contract, which mean it could have not been accurate even with late or missed payments the contract time has over doubled. My credit is about to get hit hard as the car a 2013 ******* ****** with over ****** miles is being auction. I feel I was either misled, misinformed or even deceived by this company.Business Response

We do not make goodwill modifications to accurate credit reporting. This is because of fair lending/servicing concerns because we should treat similarly situated customers the same way. Balances amortize more slowly when almost all payments are made late. Accounts amortize per the original schedule when payments are timely made as agreed. This is why we disclose this fact to our customers and provide the following information: How does the timing of my payments affect my account?
The timing of your payments will vary the finance charges you owe. Since finance charges will accrue daily for simple interest contracts, the actual amount of finance charge and the actual amount of your final payment will depend on your payment record. If you make every payment on the due date, you will pay off the contract in the time frame and amount described in your contract. If you make your payments before the due date, you will pay less in finance charges. The later you make your payments after they are due, you will pay more in finance charges. This illustrates the importance of making payments on time.
For example, continuing with our last example, if we receive and apply your payment 31 days from the date we received your last payment, your finance charges for that period would be $148.74 ($4.7981 x 31) and your payment would be distributed as follows:
Finance Charges/Interest: $148.74
Principal: $266.43
Total: $415.17
However, if we receive and apply your payment 45 days from the date we received your last payment, your finance charges for that period would be $215.91 ($4.7981 x 45) and your payment would be distributed as follows:
Finance Charges/Interest: $215.91
Principal: $199.26
Total: $415.17
This demonstrates the impact late payments will have on your unpaid principal balance and the interest you will pay.
What else other than late payments will impact my payment?
Depending on your contract,you may be subject to a late fee if the monthly payment is not made within the grace ************* Depending on your contract, you may be subject to an NSF fee for payments made with insufficient funds. If permitted by the contract and state law, part of your payment may be applied to these fees prior to principal. Payment extension(s) will result in a longer repayment period than originally scheduled. A payment extension(s) will result in more finance charges/interest accruing on your account and a higher principal balance than if payments were made as originally scheduled in your contract. Interest will continue to accrue during the extension period and your payment following the extension period will be disproportionately allocated to the unpaid interest. First Investors telling me I have to wait 10 days to request my title release letter, then wait for request to be approved & letter to be physically mailed to me, wich could take another 7 to 10 days. Under NYS NYVTL Section 2121. It states immediate release of lien to the lien holder, within 3 business days of the cleared payment. My loan is showing paid in full account closed. Why is this not being followed? They are refusing to send me the letter before the 10 days?Business Response

The law that you cite does not apply based on the facts. The law requires the following: "The lien holder must release the lien in a manner prescribed by the Commissioner of Motor Vehicles and mail or deliver the release to the owner. The only time requirement is that the release must be filed and mailed to the owner immediately upon clearance of payment of the payoff amount. If the payment is made in cash, certified check, intra-bank fund transfer or an uncertified check/draft by an insurance company authorized to do business in ********, the payment will be deemed to be cleared upon receipt. N.Y. Veh. & Traf. Law 2121." This payment was made by ACH via telephone and cleared upon receipt. A payment made cash, certified check, intra-bank fund transfer or an uncertified check/draft by an insurance company authorized to do business in ******** is safe and will not be reversed. Since made via ***, we have more time until clearance is confirmed. Based on the method of payment, we are releasing the title at 15 calendar days since it will be released electronically. My 2020 Chevrolet Equinox was repossessed on April 15th, 2025. I didnt receive any notice. After my vehicle was taken, I called to see what my options were. I had to speak with Stellantis Financial who owns First Investors and I spoke with ******** who guided me through the process. I had to pay a full amount of $1,254.90 to get my vehicle back. This included the payment for ****** **** and June 2025. I was able to get the money and paid First Investors via *************. I got my vehicle back and was told that I do not need to make a payment until July 2025. As of today, June 4, 2025 I keep on getting calls due to missing my May payment. I spoke to an agent named **** who stated that I had to pay for January, February, and March!! **** had me send the letter that I received and she will forward it to management. According to them, my payment is now late for May even though the letter that I received told me that I had already made the payment for May!!!Business Response

It is categorically untrue that you did not receive notice prior to repossession. A notice (attached) was sent to the address on file which is the same as provided to the BBB with this complaint. We also attempted to contact you via telephone using the same number that you have provided to the BBB with this complaint, but you did not answer or respond. That being said, you are correct in that the reinstatement amount that you paid should have moved the next due date to July 24, 2025. We have investigated and the results are as follows: "Customer was quoted for reinstatement on 4/15/2025 and on 4/24/2025 a payment of $250 returned which impacted the due date. Customer was quoted correctly, but due to return, the system did not update. This is being updated today." You should see the due date update over the next day. I paid off my 2020 ****** Altima by trading it in for a new car . I received a paid in full letter from First Investors Corporation that my car was paid off on 02/04/2025. I had to submit the required documents to there rebate department twice as supposedly they didnt receive them the first time for them to process my gap refund & in order for them to mail me a check it is mentally exhausting every time I speak with someone including Management they keep giving me these stupid excuses& the run around about my refund it is unfair thats its almost 4 **************** is being done.I was told by ****** 05/13/2025 the check was mailed on that day . & for sure I will receive my refund check within 57 business days. Pls help me get my refund like yesterday. I need whats mine thats owed to me. Its 05/19/2025 no refund received I was called today twice by them to be lied to once again. He advised me to allow a week, then call back on 31-MAR-2025. I called back to day, and the call kept getting disconnected. when i finally got a young Lady on the phone, she advised that my payment was 22 days late, and when i tried to explain that i had submitted the payoff amount of $6029.07 on 10-MAR-2025, she put the call on hold and never came back to the phone. ********* ***** and ***** ******** purchased a Compass in 2022. The unit was stolen in July 2024. We've submitted all requested documents including police report. Our insurance company sent approximately $18, 000. This left a balance of about $11, 000, which has been paid by Allied for gap insurance. My credit report shows the account is still open and active, which prevented me from getting another automobile. It's been confirmed that allied has paid their portion to close out the loan. It's been almost a year. Please help. Also, I was employed by then and still was unable to speak to anyone to help me. You can never get through to anyone in Insurance.Business Response

First investors is not allowing me to pay on my account. This is ridiculous. Because I made 2 payments this month they literally will NOT allow me to pay more. How is it they can hold the title of my truck ****** if I can pay it off is beyond me. This better be fixed and it better be fixed immediately. They are still refusing payments on the account. I've never missed a payment. I'm trying to pay more than I owe. THEY ARE REFUSING. Whomever addressed this complaint should be fired. I attached a screenshot from their own website showing their refusal to accept payment. The *** complaint is filed. I'm filing with the AGs office next.
