I am writing to express my concern regarding RS Clark Collections' violation of the ***** Finance Code pertaining to Account Number ********************. Despite sending a certified letter requesting debt validation within the 30-day timeframe, as mandated by the ***** Finance Code, their organization failed to respond within the stipulated period. I am not liable for the debt with RS CLARK & ASSOCIATES. I do not have a contract with surgical consultants of ****** nor did i PERSONALLY see them. I attempted on multiple occasions to solve the problem directly with the collection company who continues to report verified without any proof or documentation. I also did not not provide a third party hipaa release. .You guys need to handle this issue. This has been going on for a long time now that I have seen my information. .They are in violation & told me 30 days when I had fraud. they are in major violation. i am attempting to refinance my house and this fake collection is causing harm and will soon lead to damages.Business Response

I recently received a copy of my credit report and found that RS *********************************** is illegally reporting inaccurate, noncompliant, and false information about me. The following alleged account is listed as a collection with a PAST DUE BALANCE of $1559 Account Number, **** This is a violation of the **** and is also in violation of requisite METRO 2 Compliant reporting standards.By the provisions of the Fair Credit Reporting Act and per the standards of reporting compliance implemented with the **** enacted CDIA Metro 2 COMPLIANCE regulations, I have the right to a fair and accurate credit report, and you are required to remove any information that is not true, accurate, compliant, and verifiable. I recently pulled my credit report and notice there was a collection that I have no knowledge of and doesnt relate to any transaction made by me. I have been reaching and am fully aware that a debt collector must send me written communication prior to furnishing anything to a consumer reporting agency. I have not received a single piece of mail form this company I only became aware of them when I saw the collection on my consumer report. I sent a letter to the company requesting validation of these unknown debt and I have yet to receive any communication from them. It has come to my attention that you have violated several provisions of the Fair Debt Collection Practices Act (FDCPA), specifically 15 U.S. Code **** because they didnt validate the debt and 15 U.S. Code ****f for false and misleading reporting furnishing to my report without following FDCPA guidelines. They have engaged in false misleading reporting by saying I owe a debt without providing any supporting documentation or evidence to validate the legitimacy of this alleged debt. The lack of information provided by violates my rights under the ****** which require that debt collectors provide clear and accurate information regarding the debt. The actions taken by this company are unfair practices under 15 U.S. Code ****f. By attempting to collect a debt without providing proper validation and verification. They have caused me and my family unnecessary distress and anxiety. These actions are not only unjust but violate the ****** which explicitly prohibits unfair practices in debt collection.I never received written verification of the alleged debt within five days of communication. To date, I have not received any such validation or verification from the company. On April 21, 2023 someone from RS Clark and associates called and was extremely rude to my wife. Using profane language such as pull your head out of your ***. I called them and was transferred to an individual claiming he was **********************. He processed to berate me, call me an ignorant wretch and say that my wife was an airheaded b****. They also claimed that they were going to sue *** garnish our wages, and put a lien on our home. These people were extraordinarily unprofessional and rude.
