On January 18, 2023, the City of Cincinnati filed a Complaint for Breach of Settlement, Public Nuisance, Preliminary and Permanent Injunctive Relief, Declaratory Relief, Appointment of a Receiver and Damages (Case Number A 2300224) in the Court of Common Plesa in Hamilton County, OH. Charges filed allege the business breached the 2021 Settlement Agreement, claims of being a public nuisance, civil conspiracy, and in violation of the Ohio Landlord Tenant Act and Cincinnati Municipal Code. In June of 2024, the business and the City of Cincinnati reached a Settlement establishing a new working relationship between both parties. This matter is pending.
