    I entered into a contract with ***** (**) ******* on 8/14/2022 and paid an initial $11,675 deposit. It took some time to get the permits and ** requested and additional $2800 to pull the permits. He edited the contract to include schedule payments based on completion milestones. To date I have paid over $28,473 and he has completed a partial demo and claims that he doesn't have any money to buy materials or continue and I would have to pay more up front or wait. My house is now exposed to the elements and only purchased less than $5000 worth of materials.

    First and foremost, I want to say I did everything I could to get the Client done as much as I could.  Since covid, I have had to try and keep going with shutting the company down in its entirety.  As per contract the contract I did purchase materials, but hes mentioning ******* in materials and ******* in permits fees and insurance to pull the permit.  2nd the customer is saying ********************** CO,  he has no contract with ARK REMODELING.   that is my sons company that pulled the permit, since all my insurances had expired to the wait for the permit and the nature of coming out of covid without taking and PPP loans or anything for small business.  THE Customer has a contract with NY HOME RENOVATION, NOT! ARK REMODELING, sorry for the exclamation point its just a highlight btw. I edited the contract so we can keep the job moving reducing the payment plans with more milestones.  Even to the point I had him write the full 2nd check for **** to the ***** and not me directly but to my project guide ******** and his guys , the only other check I asked him was to pay for the next phase of brick and materials and again give the moneys all to the guys that work for me.  So the only moneys that he should be referring too would be the next payment for the materials and labor, basically i was ahead one progress payment and the next to the guys working.

    I tried to work with him under the circumstances and pleaded with him to work with me as a team, I understood his frustration totally.  So I asked him just to purchase his own materials take it out of the balances owed for the work and we could keep working since NY HOME RENOVATION is and was about to close the doors around april.  

    Again Ark remodeling corp has no standing contract with ** ******** they only pulled the permit which they produced...

    As for NY HOME RENOVATION CORP. I am closing the company and filing a chapter.  *************** with attorneys to see my bankruptcy options.

    Ty Represents both NYHomes and *************** He changed mid-contract because to ************** and as you can see from the contract cover page, it includes both NYHomes and ************** under his son's name, but you can see from the contract, that he identifies as the President. He asked that the subsequent checks be made out to Ark Remodeling which I have attached.
