Dispute letter: Family Education Rights Privacy Act (FERPA) strictly prohibits unauthorized access, modification or deletion of student records without explicit consent of the student or borrower only. NelNet's failure to properly address my dispute constitutes a blatant violation of federal law which carries significant legal consequences. I am formally escalating my issue and would like the following action immediately: 1. Comprehensive investigation into the unauthorized access of my student loan records 2. Fully documented result of the investigation 3. Written summary detailing your findings. This is a breach of privacy and demands immediate attentionBusiness Response

NelNet is a loan servicer, which they're saying the FERPA guidelines don't apply to. However, I have not authorized them, as a loan servicer, to access any of my personal information that was provided directly to the school. So, I'd like a complete, detailed summary of exactly where they were authorized to get my information from and where I authorized them to turn my information over to any of the primary or secondary credit bureaus.Business Response

Nelnet reported missed payment 6-7 times to the credit bureau for 1 consolidated loan. If a missed payment took place it should have been 1 missed payment reported, not multiple. The pay back method consolidates to one amount, not 6-7 small amounts. What they are doing is predatory.
I’m asking that nelnet rectify this error by replacing multiple missed payments reported, down to 1 accurately reported missed payment.Business Response

I have worked for ****** ******** ****** ****** ***** *or over 14 years and had my student loan forgiven years ago only to find out last month that it was bought by Nelnet and put back on my credit report dropping it down by a whopping 150 points. This error not only crippled any chance of me getting any kind of additional credit, but it also inhibited me from getting a lease on a previously approved apartment.
I have documents stating my good past payments on my student loan for years and my sudden drop in my credit score due to this error. I am also asking that I get compensated for the loss of the lease I was previously approved for of $3,600 for $1,800 a month.
This error has caused me much stress and I would like this student loan account removed from my credit report as soon as possible. I recently lost my transportation and just found out I can no longer get a previous preapproval of a car purchase as before.
Please let me know when this error is fixed or if I need to seek legal assistance in this matter.Business Response

On February 7, 2025, a data breach exposed my personally identifiable information (PII), including sensitive federal student loan details managed by Nelnet. This breach was beyond my control and has placed me at risk for identity theft, financial fraud, and credit damage.
I was not notified in a timely manner, and despite reaching out to Nelnet for clarification and resolution, I have not received adequate support or assurances regarding the protection of my information. Given the severity of this breach, I am seeking:
Full discharge of my federal student loans due to the unauthorized exposure of my private information.
Credit monitoring and identity theft protection at no cost to affected borrowers.
A full investigation and accountability for the mishandling of borrower data.
Nelnet has failed to properly safeguard my information, and I am requesting that they take full responsibility for the harm caused by this breach.
I urge the Better Business Bureau to assist in facilitating a resolution to this matter.Business Response

Nelnet's response fails to adequately address my concerns regarding the February 7, 2025, data breach that exposed my personal and financial information. The company denies responsibility for any unauthorized access to borrower data, yet I, along with other affected individuals, have experienced a violation of privacy that puts me at risk for identity theft and financial fraud.
Additionally, Nelnet did not provide any meaningful resolution to my request for loan discharge, nor did they offer credit monitoring, identity protection, or an independent investigation into the breach. Simply stating their compliance with regulations does not negate the fact that my private information was exposed through no fault of my own.
I continue to request:
A full discharge of my federal student loans due to the data breach.
Free credit monitoring and identity theft protection for all affected borrowers.
A formal investigation into the breach and accountability for those responsible.
I respectfully ask the BBB to escalate this complaint as Nelnet has not provided an adequate resolution.*********** *********

Dear Nelnet,
I am writing to formally request the full cancellation of my student loan debt due to violations of my rights under the Family Educational Rights and Privacy Act (FERPA). My personal and financial data has been compromised, directly impacting my privacy and financial security.
Under FERPA, my educational and financial records should have been protected from unauthorized access, yet a breach has occurred, putting me at risk. Given the severity of this violation and its potential consequences, I request immediate action to discharge my student loan debt in full.
Please provide a written response confirming the steps your office will take to process this request. If additional documentation or steps are required, kindly inform me at your earliest convenience. I expect a resolution in accordance with federal protections and consumer rights.
Thank you for your prompt attention to this matter. I look forward to your response.Business Response

Due to their error they have destroyed my credit. I was supposed to be put on a 0 payment plan and a few days ago I woke up to my credit being damaged by over 100 points. One of their employees apparently did not enter something correctly. The last rep i spoke with stated that it is in the notes that I was supposed to be on the program. They said they can't fix it now and nothing they can do but put me on a program now. This has lead to destroyed my %100 on time payment history and they are not willing to fix their wrong. From the reviews I have read on here it seems to be a on going issue.Business Response

I am rejecting this response because:When i spoke with the first rep that was supposed to get me into the program that required the info from me said I would have to mail the forms sent out which I did. Since it never reached you I was not aware until my credit was hit for being delinquent. I was not told that I could get online to just upload information. I uploaded information that was requested the last time I spoke with your rep. I previously had the same issue with your company years ago as well. I have all the unemployment information needed and can send as requested or upload the information since I was now aware I could do so. Everything is backdated and should have the 3 months of miss payments removed from my credit history. With the issues of being misinformed should not be my fault. It has destroyed my 100% payment history to all my obligations. Why would I intentionally destory that?
Sincerely,

It is literally impossible to get into my account. When I try requesting my username and I enter my social and DOB it says my information does not match any records YET YOU REPORTED MY LOANS AS DELINQUENT AND TANKED MY CREDIT SCORE. So clearly you have my information!! Then both emails don’t work apparently and trying to get someone on the phone is impossible. This is wrong, truly, truly wrong. My life is literally over because of yall. My credit score that I had been rebuilding just ruined just like that. Yet apparently you have ZERO record of my literal social and DOB but had NO problem reporting me to credit agencies. Truly disgusting.Business Response

your federal student loan account with Nelnet. On behalf of your lender, the U.S. Department of
Education (ED), we service your federal student loans. We take your concerns seriously and
appreciate the opportunity to respond.
Your concern, as we understand it, is that your loans were reported as delinquent and it ruined your
credit score. You cannot access your account online. You are asking us to fix your credit score.
Based on your concern, and our review of your account, we verified you spoke with a representative
on March 18, 2025. They assisted you with your login information, so you were able to access your
account online.
Under the Fair Credit Reporting Act, we have an obligation to ensure data we furnish to consumer
reporting agencies (CRAs) is complete and accurate. Based on your request and the information you
provided, we carefully reviewed your concern, and the corresponding data furnished to the CRAs.
Our investigation indicates the data accurately reflected your loan status at the time it was furnished.
Due to the continued delinquency occurring on your loans, the data we furnished February 2025
reflected your past due status. On March 18, 2025, your account was no longer past due because
you requested a forbearance which brought your account current.
While your loan was in repayment, we sent you billing statements each month. When your account
became past due, we also tried to reach you in other ways such as calling and sending email to help
bring your account up to date.
If you disagree with our initial decision, please send us new information including the basis of your
dispute and supporting documentation to the address in this letter. Please be sure to include your

I have contacted them at least 3 times now. one I requested a history of all the payments I have made on my loans because my information was sold to them from great lakes I am not able to access information. Instead they sent me a letter showing all of my loans that have been discharged, Second every time I call I ask why they have not updated the credit bureau I have spoken with the Department of education and even on their website it shows my current balance is 79,000. They are showing I owe : $200,178 which is extremely off this effects my debt to income ratio and lowering my score. CSRS when I call say they dont know who I would speak to for that to be corrected. ON my credit report they are showing as the debtor so they are responsible according to the department of education for updating this.Business Response
