Requesting refund from ABC Pest due to misrepresentation of product sold and failure to correct pest issues caused by product. On 12/3/24, purchased 5 boxes from ABC Pest to address mouse issue at house. Requested and thought we purchased exterior mouse traps to keep mice out of house. After finding multiple dead mice inside home/yard + green mouse droppings (indicating poison was ingested), we called ABC Pest for clarity on products. On 12/6/24, informed by phone that products sold were "rodent stations" i.e. poison bait boxes. Then told that ABC doesn't sell outdoor mechanical traps; this was NOT communicated at time of purchase. We are against poison traps due to dog at home, concern for native wildlife, and ethical objection to use of poison, and never would knowingly purchase. On 12/11/24, we again called. Dead mice in ventilation system, causing house to smell foul. Spent 3 hours searching for/removing dead mice ourselves; ABC offered only odor-eliminator bag for approx. $25.00 + to refill bait stations (fee). See attached email from ABC: "Our notes state that the customer would like to add rodent stations. 5 rodent stations were purchased 10/03/24. There are no other options for mice other than rodent stations. Mechanical traps outside do not work properly. Unfortunately on occasion you will experience an odor from a dead mouse. This does not happen very often." We found 6 dead mice inside our home on 12/11/24. At 12/19/24 visit, technician apologized for miscommunication about the rodent stations at the time of purchase and encouraged us to call the office to resolve the issue. ABC has refused requests by phone, writing, and in-person to issue refund. We were not sold the product requested; poison boxes created a new issue costing money + time to address. We are frustrated due to poor customer service, lack of clarity in communication regarding the product at time of purchase, and refusal to issue a refund/credit to our account and correct mouse issue.Business Response

Ian was a pest control maintenance program and on Oct 23rd he added rodent control due to having mice issues. He was explained the process according to the technician and after having the rodent nearly two months he called the office to complain that he had dead mice. He was on a recorded phone line and was explained the process again. He then had his mother in law call on his behalf and complain, she was explained the same process to her, so then she proceeded and paid for an odor bag, which is needed sometimes with an older house that also may need some repairs in addition to the rodent control. When mentioning this to her she stated YES the foundation is in of some serious repairs. I also told the mother in law that they are more than welcome to utilize a free call back we can see what other adjustments that the service may need, which Ian never took advantage of.
When adding rodent control we always make other recommendations whether the homeowner decides to do so or not. When mentioning kill traps Ian was explained they freeze, break in outdoor elements and simply can't keep up with the activity especially in high traffic areas like this property was experiencing.
ABC does not feel or will we be refunding ***** money for the equipment that he voluntarily purchased.

ABC did an automatic renewal of a one year contract. At the start of the contract the salesperson was told that I wanted one year only, on 8/10/2023. The salesperson may have failed to enter the end date into the company files, as they did a renewal on 8/07/24 and billed me 85.80 for an additional treatment, I don't believe I received any notification that they were about to renew the contract. I have a number of rentals and this is the first time the did an automatic renewal. I would like them to delete the charges for the 1 additional service in the amount of $85.80. *** ***** did sign a contract and prepaid for 6 services however, the original contract does not appear to have a cancel date notated on this contract. Line #24 on the contract, above his signature states the on going process after the initial contract. He states that the salesperson "may have failed to notate" and he also states " I don't believe I received any notification of services". Our software shows *** ***** received an auto generated reminder email on 7/31/24 and a text message reminder on 8/6/24 for services to be rendered on 8/7/24. *** ***** has no complaint on file of ever having any trouble receiving previous reminders. I decline to remove the $85.80 and do find *** ***** is responsible for these charges. I also exercise the right to refuse *** ***** any future ABC services due to his recorded comment of threatening to post untruthful information on several social media sites.

A complaint was filed by another individual on 10-6-21 about them signing a tablet purported to be a credit card authorization only to also have a contract attached. Upon signing, you have entered into that contract and are obligated to pay a $165 early termination fee. The response to that person was that ABC ALWAYS tells customers that they are signing a contract. I WAS NOT INFORMED OF THIS EITHER. Doesn't this show and prove a pattern of unethical business practices? When I called the company to inquire about why this fee is even included, I was told so that the salesperson could get commission for the entire year's sale, and that if it wasn't included, EVERYONE could just cancel. Doesn't this also show the lack of incentive for the salesperson to not be forthright? This cannot be the standard that BBB wants their members to uphold.Business Response

***** called our office asking to get out of his service agreement. The agreement hadn't been completed, so we explained that to him. He admits to signing the contract, but said he didn't read it. We explained that we could cancel it, but there is a early termination fee. ***** did not want to pay that, so he said he was going to send a complaint to BBB.Customer Answer

I am rejecting this response because: It does not address the root cause of the complaint.I did call in and acknowledge that my signature was located on the bottom of a contract. I explained that I felt the signature was obtained under false pretense. I signed what was explained to me, to be a credit card authorization. The salesperson never informed me that there was a contract out of view of the signature line on his tablet.
I also asked why the early termination fee was even a part of the contract since it does not cost the company any money to NOT further provide services. (Looks like a money grab) The explaination I received is it is there to protect the salespersons commission. Doesn't this form of commission structure reward the signing of contracts?
I do not dispute that I owe the money per the contract. My check is being mailed today. My legal counsel also advised me that ultimately, "I did have my signature on the contract"
Lastly, upon reading other reviews, I have found a minimum of 4 other individuals making the same claim recently. Has any research been done to see if these contacts were obtained by the same salesperson? Remember, they have a financial incentive to obtain yearly contracts.
