    I had an account with ********************************************* from February 2019-February 2023. The car that I had financed with them was repossessed in April of 2023 due to some economic hardship that I experienced. Since then, I have not received any notice that I still owed them money. On my credit report, it shows as a repossession, and they have not offered me any opportunity to settle the past due ********** looking for a possible resolution to either offer me an amount to settle the account and/or an immediate removal from my credit reports. This repossession is hurting my chance to finance another vehicle.

    I am filing a complaint against Brite Financial Services for reporting an account on my credit file that I believe is invalid. I have no contract or agreement with this company indicating that I owe them any money, and I am unfamiliar with the debt they claim I owe.I have repeatedly requested a copy of the original signed contract or documentation proving my liability for this debt, but they have failed to provide any such proof. Without this evidence, their claim is baseless, and their reporting is both inaccurate and unjust.This continued reporting of unverified and unsupported debt is causing harm to my financial standing and violates consumer protection laws, such as the Fair Credit Reporting Act (FCRA) and the Fair Debt Collection Practices Act (FDCPA).I am requesting the following actions:1. Immediate removal of the account from my credit report.2. A formal response explaining the basis for their claim, including the provision of all supporting documentation.3. A commitment to comply with consumer protection laws moving forward.Failure to address this matter appropriately will leave me no choice but to pursue additional remedies, including filing complaints with regulatory authorities such as the Consumer Financial ***************** (CFPB).

    The lease went in default resulting in a repossession on 2/6/2019. 

    The Deficiency balance of $6,302.57 was provided by letter in a demand for payment sent 3 times 1st 7/18/2019, 2nd 7/31/2019 and a FINAL demand on 8/9/2019. 

    The file was placed with the ********** ******* & ***** on 09/18/2019 for the amount of $6,302.57. The following is their report.


    A lawsuit was filed on 12/18/2019.
    Maleek was personally served on 01/29/2020 at *************************************
    A judgment was obtained against Maleek on 07/13/2020 for $6,499.10.
    Actions to recover the judgment:
    Garnishment on 2020 tax refund from the ***************** : $152.00 recovered.
    Bank Garnishment on 09/07/2022: $0.88 recovered.
    Current address on record: **********************************************************************************************************

    The matter now despite having been adjudicated, a Judgment granted and our attorneys best efforts to resolve remains unpaid.

    Brite Financial Services LLC failed to properly investigate a dispute I raised regarding an error on my credit report within the 30-day period required by law.They began reporting inaccurate charge-offs on my Experian credit report in April of 2021. They have not reported any activity to ********** and they have reported a perfect payment history to *******. On August 22, 2024, I sent Brite Financial Services LLC a letter via certified mail with a return receipt, disputing a false "charge-off" that they are reporting on my Experian credit report. The account in question was fully paid off, and as such, there was no outstanding debt to be charged off. Despite providing this information, Brite Financial Services LLC has continued to report inaccurate information to the credit bureaus.Additionally, if Brite Financial Services LLC indeed charged off a debt, they were legally required to issue me a 1099-C form, as per tax law. However, no such form has been provided, which raises concerns that they have committed tax fraud by failing to properly report the alleged charge-off.I have disputed this false information, but Brite Financial Services LLC has repeatedly verified the inaccurate information. This failure to correct the false reporting and their neglect of my dispute constitutes a violation of the ******* a result of these actions, I am requesting that Brite Financial Services LLC immediately remove the false "charge-off" information from my credit report. Their continued reporting of this false information is damaging my credit score and affecting my financial standing. I am unable to grow my small business because the false information is damaging my reputation and causing me to be consistently denied all forms of business funding.Please investigate this matter and take appropriate action against Brite Financial Services LLC for their violation of the **** and potential tax fraud. I look forward to your assistance in resolving this issue.

    I have just received a garnishment from this business and I have no Idea why! I am not even sure of the vehicle that was involved being that every vehicle I have been sold since being back in MS there is always some sort of corruption involved. If I am not mistaken this vehicle was repossessed while I was in the hospital having a stillborn baby and I was told I could not pay any money to receive the car back and when I went out to purchase another vehicle (months later) they "allowed" me an opportunity to give them money to receive the car back. I had no idea they were still after me being that was 5 years ago and I know debt follows you to death but I would like to have just known a little heads up before garnishing money from me that I have no idea about. Also can I at least see why I am having to pay for another entire car? Let me know something! Give me an opportunity to at least TRY to work out a payment plan. Is there just no type of order when cars are involved in this state? This company can repossess my car 5 years ago and bully me and then TAKE MY money with no explanation or paperwork? Help me cause i am quite confused. I just need an explanation of some sort. Thank you kindly

    I have never had an account with ***** *******************************************. I reached out to them for a copy of my signed contract with them and they will not provide me with one.

    I have paid off the 2015 **** fusion I also overpaid 18, 000 dollars and I returned the vehicle I can understand why this is still on my credit.

    On Jan 31 2023 Brite financial sent they repo man out to repo my car at the house where me and the car were there was people out side looking and asking questions as to what was going on one of them man's asked why was the repo man taking my car and can he get stuff out my car and the repo let him and also the repo man told these man all of my personal business as to I was late on my car payments who I pay the payments to that he was looking for me that he had another address for me but it wasn't over there and that he was riding by the house where the car was currently at and was just telling these man more and more of my business until I came outside and then he stop talking. I feel like Brite financial and their worker the repo man violate my rights make them responsible for paying compensation I feel like I was involved n a spot delivery scam or yo-yo sale, The Repo Man Breaches the Peace During the Repossession "you may not take the car generally suffices under laws for vehicle repos as an unequivocal protest and will require the repo man to stop the repo process. If he doest, hes likely breached the peace during the repossession. He told me I shouldn't put up a fight and just give the car back it will be better for me. I would like for the pay for pain and suffering of $4000 or somewhere in the middle or I can take legal actions. They are reporting false information to the credit bureaus

    Thank you for forwarding to us the complaint ******************** made with your office.While BRite is disappointed to hear that ******************** is not satisfied with her experience, we continue to believe that all of our actions are justified by the terms and conditions of her contract and Brites own policies and practices.

    First,by way of background, the following is a chronology of pertinent events regarding our relationship with ********************

    March 21, 2019 - ******************** leased a vehicle from a CARite dealership in **********, ** which was assigned to our company (agreement previously provided).
    Over the course of her lease ******************** had difficulty keeping up with her obligations as stated in the terms and conditions of the lease (such as making timely payments and maintaining current liability insurance on her vehicle).
    January 30, 2023 - ******************** called BRite Financial to discuss the terms and conditions of her lease. BRite explained that ******************** was past due on her account. BRite indicated that we had been very lenient with ******************** by allowing payment arrangements that were more favorable than the terms and conditions of the contract. However, despite our leniency, BRite advised ******************** that she was still past due on her account and would have to pay at least $70.00 or her car would be placed out for repossession. ******************** indicated that she wouldnt pay anything further on the vehicle and threatened to get an attorney unless BRite handed her the title.
    January 30, 2023 - ******************** was 83 days late and over $1,400.00 past due. As a result, BRite authorized the repossession of the vehicle which was recovered by AAR on January 31, 2023.
    January 31, 2023 - ******************** filed a complaint with the BBB (Complaint ID ********* alleging that BRite Financial violated the contract by adding unexplained fees and charges to her account.
    BRite responded to the BBB complaint on February 1, 2023 again explaining our position and policies to ********************.
    February 10, 2023 - Unsatisfied with BRites explanations, ******************** sent the same complaint to the ******** ************************ (Complaint No. 2023-CP01311739886-A). BRite received the ** complaint on February 23, 2023 and responded on March 06, 2023. This is now the third time BRite explained its position to *********************
    March 12, 2023 - ******************** filed a second BBB complaint. Note, that in all of our conversations with ********************, this is the first time she has made any accusations of inappropriate behavior by the repossession agent or made any mention that she felt her credit was being incorrectly reported.

    BRite would now like to take the opportunity to clarify our policies surrounding the concerns brought forth by *********************

    First, BRite would like to address the concerns regarding the alleged behavior of the repossession agent. BRite would like to clarify that we never send our own employees to repossess vehicles. BRite places repossession requests out to licensed and insured companies that are very familiar with the rules surrounding repossession in the State which they do business. In ******************* case, Ace Auto Recovery (AAR) is the company that handled the repossession of her vehicle. If ******************** has complaints about how the repossession went, she will need to reach out to AAR at ************.

    Secondly, BRite would like to confirm that we have reviewed the trade lines associated with ******************** credit and believe them to be reporting accurately.If ******************** has documentation that shows inaccurate reporting on BRites end, she is welcome to share it with us and BRite will review again and, if necessary, make appropriate corrections.

    Brite believes that we have been more than reasonable regarding the actions it has taken with ******************** account. BRite Financial will not accept Ms. *************** for $4,000.00 and will continue to enforce the terms and conditions of ******************** contract. ******************** currently has a deficiency balance of $2,760.11. Should ******************** wish to resolve this matter she should reach out to BRite Financial.

    This vehicle was illegally repossessed, I was never was giving the option to retrieve this vehicle. I believe that this vehicle was resold and I never got the option to pay the balance, abd it's now been reported on my credit. Also I never got a garnishment nor have I been to court.

    Thank you for bringing ********************** concerns to our attention. ****************** leased a vehicle through BRite Financial in January of 2018. Over the course of her lease, ****************** fell behind in her payments and in July of 2018 she was $1,662.24 past due. BRite called ****************** several times to advise her of her deficiency balance and the steps that would be required to avoid repossession of her vehicle (full payment of the $1,662.24 past due amount + $578.62 for her scheduled payment). ****************** advised BRite that she couldn't afford the vehicle and BRite proceeded with the repossession process

    BRite Financial believes that it has been more than reasonable during this process. Prior to repossession, BRite gave ****************** multiple opportunities to pay her balance and avoid repossession. Since the repossession, BRite has provided ampel notice and opportunity for ****************** to pay her deficiency balance and make her account whole. She has failed to do so. BRite Financial is confident that it has met all legal requirements that were in place when we repossessed this vehicle.

    Since the repossession, ********************** account has been charged off and sent to BRite's legal collections department. ********************** current deficiency balance is $8,636.39. If ****************** wishes to resolve this matter, she should contact BRite Financial.
